Rationale of the Commission
51. The Commission noted the Working Group=s wish to see a change in the approach to and presentation of the Commission=s sessional and annual reports. This would include a more contemporary layout that took advantage of modern publishing software technology, e.g., desktop publishing. Sessional reports should be more detailed than annual reports, containing the entire discussion, including any divergent views; the annual report should be more succinct, and should present the consensus view. The experience of the Commission, however, was that the General Assembly wished to receive the fullest possible information regarding the deliberations of ICSC and its decisions; it might be difficult to reconcile the proposed change regarding the reports with the requirements of the Assembly. The Commission noted that the Working Group considered this amendment necessary to ensure that the views of the administrations and staff representatives were reflected in the body of the report. ICSC considered, however, that in the last clause of the sentence, Aincluding the views expressed ...@, the words Amembers of the Commission@ should also be included; that would ensure that all individual views and ideas that were part of the discussion would appear in the body of the report rather than in a separate annex, as currently provided for in rule 21.3. The views of the Commission were by definition included, since the report was a report by ICSC; that was reflected in article 17 of the statute.

Rationale of the Commission
52. Noting that the reasons for the proposed change by the Working Group was to ensure that the views of the parties, in addition to those of the Commission, would be reflected after the Commission had taken its decision, the Commission considered that a reference to the views of individual members (as in the case of the amendment to rule 21.2) should also be reflected. If not, it would seem that the Commission was granting to the other parties a prerogative that it was at the same time relinquishing for its own members.
Conclusions of the Commission on changes to the rules of procedure
53. The Commission emphasized that the above changes proposed to the rules of procedure had been agreed to by all participating parties to the discussion, members of the Commission and members of the Working Group, except for FICSA, which had maintained its observer status; those changes contributed to the consultative process without detracting from the substance of the Working Group=s original proposals. The Commission understood that for some, agreeing to those changes had required flexibility; the Commission had also been flexible. The reformulation of the passages in question and the changes agreed to were a positive demonstration of a new spirit of cooperation on the part of all parties to the process.
54. Given the far-reaching effects of the proposed amendments to its rules of procedure, the Commission wished to safeguard itself against unforeseen legal implications and to ensure that the amendments were not in conflict with the statute. As a precaution, it would seek a legal opinion on these issues. Moreover, it wished to make clear that the amendments to the rules of procedure would go into effect only when the staff representatives had resumed their active participation in the work of ICSC.
