ISLANDS TRUST COUNCIL BYLAW NO. 99

A bylaw to designate the Galiano, Mayne, North Pender, South Pender, Saturna and Salt Spring Islands Local Trust Areas as an area for which

Natural Area Protection Tax Exemptions may be provided.

WHEREAS pursuant to Section 49.2(1) of the Islands Trust Act the Islands Trust Council may, for the purpose of carrying out the object of the Trust, designate all or part of a local trust area as an area for which tax exemptions may be provided under Part 7.1 of the Act; and

WHEREAS pursuant to Section 49.2(2) of the Islands Trust Act, the Capital Regional District Board passed a resolution on May 12, 2004 consenting to the designation of lands within the Capital Regional District and within Galiano, Mayne, North Pender, South Pender, Saturna and Salt Spring Island Local Trust Areas for natural area protection tax exemptions; and

NOW THEREFORE the Islands Trust Council, in open meeting assembled, enacts as follows:

Citation

1. This bylaw may be cited for all purposes as "Islands Trust Council Designation of Natural Area Protection Tax Exemption Areas Bylaw No. 99, 2004."

Area

2. All of the Galiano, Mayne, North Pender, South Pender, Saturna and Salt Spring Islands Local Trust Areas as shown on Schedule “A” as attached to and forming part of this Bylaw are designated as an area for which tax exemptions may be provided pursuant to Part 7.1 of the Islands Trust Act.

Severability

3. If any section, subsection, sentence, clause or phrase of this bylaw is for any reason held to be invalid by a decision of a court of competent jurisdiction, the decision shall not affect the validity of the remaining portions of the bylaw.
