NOTICE OF COMPLETE APPLICATION AND PUBLIC MEETING PROPOSED ZONING BY-LAW AMENDMENT

A complete application has been received by the City of Guelph’s Planning Services to amend the City’s Zoning By-law for the property municipally known as 209 to 211 Liverpool Street, in accordance with the provisions of the Planning Act, as amended. The application was received by the City on January 29, 2015 and deemed to be complete on February 26, 2015.

PUBLIC MEETING

City Council will hold a Public Meeting in accordance with the Planning Act for the Zoning By-law Amendment application from Mark Lough on behalf of The Chandler Holding Company Limited for the property municipally known as 209 to 211 Liverpool Street.

Meeting Date: April 13, 2015

Location: Council Chambers, City Hall, 1 Carden Street

Time: 7:00 p.m.

SUBJECT LANDS

The subject property is located on the north side of Liverpool Street, between Arnold Street and Edinburgh Road North (see Location Map). The subject property has an area of 820 square metres (8,826.4 square feet) and a frontage of 25.7 metres (84.32 feet) along Liverpool Street. There is an existing semi-detached dwelling on the property and a detached garage located behind the dwelling unit at 209 Liverpool Street.

Surrounding land uses include:

 To the north: lands zoned for and developed with residential uses, beyond which is Suffolk Street West;

 To the south: Liverpool Street, beyond which are lands zoned for and developed with residential uses;

 To the east: lands zoned for and developed with residential uses, beyond which is Arnold Street; and,

 To the west: lands zoned for and developed with residential uses, beyond which is the Canadian National Railway line and Edinburgh Road North.

PURPOSE AND EFFECT OF APPLICATION

The purpose of the proposed Zoning By-law Amendment is to change the zoning from

“Residential Single Detached” (R.1B) to a “Specialized Residential Semi-Detached/Duplex”

(R.2-?) Zone to recognize the existing semi-detached dwelling and existing detached garage.

The owner has submitted this Zoning By-law Amendment application in conjunction with a severance application so that the semi-detached dwelling can be marketed and sold as two individual units (See “Details of Proposal” section of Notice).

The subject property is subject to an application for Consent (File: B-5/15) under the Planning Act to sever the subject property into one (1) retained lot and one (1) severed lot.

A 3m2 easement in favour of the retained parcel has also been requested through the Consent application.

A recommendation report will be prepared and presented at a subsequent meeting of City Council following a full review of the application.

If a person or public body does not make oral submissions at a public meeting, or make written submissions to Guelph City Council before the by-law is passed, the person or public body may not be added as a party to the hearing of an appeal before the Ontario Municipal Board unless, in the opinion of the Board, there are reasonable grounds to do so.

DETAILS OF PROPOSAL

Legal Description: Legally described as Part of Lot 7, Registered Plan 29, Northwest Side of Liverpool Street, City of Guelph

Property Size: The property has an area of 820 square metres (8,826.4 square feet) and a frontage of 25.7 metres (84.32 feet) along Liverpool Street.

Existing Land Use: The property is developed with a semi-detached dwelling and detached garage.

Official Plan: The Official Plan land use designation that applies to the subject property is “General Residential” which permits a range of housing types including: single, semi-detached residential dwellings and multiple unit residential buildings.

Existing Zoning: The subject property is currently zoned “Residential Single Detached” (R.1B), according to Zoning By-law (1995)-14864, as amended.

Proposed Zoning: The purpose of the proposed Zoning By-law Amendment is to change the zoning from “Residential Single Detached” (R.1B) to a

“Specialized Residential Semi-Detached/Duplex” (R.2-?) Zone to recognize the existing semi-detached dwelling and existing detached garage.

Proposal Description:

The applicant is not proposing any new development on the subject property. The existing semi-detached dwelling will be renovated and sold as individual units if this Zoning By-law Amendment application is approved along with the severance application.

PROPOSED ZONING

Proposed Zoning: Specialized Residential Semi-Detached/Duplex (R.2 - ?) In addition to the regulations set out in Section 5.2 – Residential Semi-Detached/Duplex (R.2) Zone of Zoning By-law (1995)-14864, as amended, the following additional specialized regulations have been requested to facilitate this proposal:

 The minimum Front Yard setback shall be 2.8 metres, whereas the Zoning By-law requires a minimum Front Yard setback of 4.5 metres;

 The minimum Landscaped Open Space shall be 0.2 metres for 209 Liverpool Street, whereas the Zoning By-law requires a minimum Landscaped Open Space of 0.6 metres between the driveway and nearest Lot Line to be maintained as landscaped open space in the form of grass, flowers, trees, shrubbery, natural vegetation and indigenous species and may include a surfaced walk in accordance with Section 4.13.7.2.4; and,

 The detached garage shall be 0.4 metres within the Side Lot Line, whereas the Zoning By-law requires that Accessory Buildings or Structures not be located within 0.6 metres of any Lot Line.
