description El presente artículo tiene como objetivo analizar y demostrar cómo el proceso constituyente y la Constitución

colombiana de 1991 presentan ya determinados rasgos que los diferencian claramente de la tradición constitucional

occidental. Unos rasgos que serán desarrollados, posteriormente, por los procesos constituyentes y constituciones de

Venezuela (1999), Ecuador (1998 y 2008) y Bolivia (2009), constitutivas de lo que se ha llamado el

neoconstitucionalismo latinoamericano. En consecuencia, lo que se quiere demostrar en este trabajo es como el texto

constitucional colombiano de 1991 supone el punto de in?exión que marca el inicio y establece las bases para el

desarrollo en América Latina de una forma constitucional propia durante las dos últimas décadas.

description The objective of this article is to show that the Colombian Constitution of 1991 has certain traits that clearly

differentiate it from Western constitutional tradition. Some of these traits would later be included in constitutional

collectively known as Latin American Neo-Constitutionalism. This paper intends to demonstrate how the text of the

Colombian Constitution represents a turning point that marks the beginning and establishes the foundations for the

development of a home-grown constitutional form in Latin America over the last two decades.
