Las exportaciones de uva que alcanzaron los 6.2 millones de dólares en el 2013 han pasado a mas de 19

millones en el 2014.

Superando a Chile en kilos por muy poco 0.15% pero en valor 5.6%, somos el cuarto proveedor de uvas

frescas para el mercado indonesio.

Harina de pescado ha venido creciendo en pequeñas cantidades entre 2009-2013 0.62%, pero representa una

gran parte una gran parte de la exportación peruana a Indonesia. El Perú en el año 2013 fue el segundo

proveedor más importante de este producto solo por detrás de República de Korea.

Durante los años 2009 al 2010 no hubo importaciones de fosfato de Peru, sin embargo entre 2011 al

2013, las exportaciones de fosfato desde Perú crecieron en 66.6% y el fosfato representa el 35.7% del

total productos exportados de Perú a Indonesia.

Indonesia actualmente importa un poco de cacao en grano de Perú. Sin embargo, el potencial de

este producto se aprecia en el incremento de las importaciones totales de otros orígenes entre

los años 2012 - 2013 en volumen creció en 38%.

El Perú dentro de su política comercial es un país que busca el acercamiento con las diferentes economías del mundo. Siendo Indonesia la mayor economía del sudeste asiático, es un mercado considerado de interés.

A la fecha, no existe un tratado de libre comercio entre los dos países. Sin embargo hay otros instrumentos vigentes y en negociación encaminados a fortalecer y facilitar las relaciones bilaterales: 1.- MOU “Memorándum de Entendimiento entre Ministerio de Comercio de Republica de Indonesia y Ministerio de Comercio Exterior y Turismo de Perú acerca de Actividades de Promoción del Comercio” firmada en Yakarta, el 10 de Julio de 2012, con el siguiente alcance:

a) Intercambio de Información en el Campo de la Economía y Comercio b) Dar facilidades para la investigación de mercado para ambas partes.

c) Organizar el intercambio de conocimiento y tecnología para beneficiarse de la experiencia de ambas instituciones en el ámbito de las actividades de promoción de exportaciones

d) Otras áreas acordadas por las partes

Este memorándum se encuentra en el marco de los acuerdos “Acuerdo entre Gobierno de la Republica de Indonesia y el Gobierno de la Republica de Perú sobre Cooperación Técnica y Económica”, firmado en Lima, el 9 de abril de 2010.

2.- PTA “Acuerdo Comercial Preferente”, como paso previo a la negociación de un TLC con Indonesia se ha planteado la necesidad de un acuerdo parcial que someta a un régimen especial a un grupo de productos de interés por ambas partes.

Este acuerdo se encuentra en la fase de grupo de estudio (JSG por sus siglas en ingles) y se espera que se reinicien los trabajos en el primer trimestre del 2015.

Indonesia tiene acuerdos comerciales con otros países a nivel bilateral y regional:

a) Bilateral, con Japón "Acuerdo entre la República de Indonesia y Japón para una Asociación

Económica” (EPA)

b) Regionales: ASEAN - Corea y la ASEAN - China,

c) Estudio del TLC, que es un Estudio conjunto sobre la posibilidad de un Tratado Libre Comercio.

Hasta ahora, los studios del TLC se han realizado con Australia, Chile, Nueva Zelanda, Turquía, la

EFTA (Asociacion de Libre Comercio Europeo) y la India

a) Procedimientos y Documentos de Importación Formalidad de los Importadores

 Las importaciones sólo pueden ser realizadas por una empresa formal registrada como importadora, para lo cual requiere el Número de Identificación Importador (API), según está establecido en el Reglamento de Ministro de Comercio número 59 / M-DAG / PER / 9/2012 y la modificación del reglamento de NO.27/M-DAG/PER/ 5/2012 sobre los requisitos para obtener el Número de Identificación de Importador (API). Si la empresa no tiene registro de importador pero tiene la necesidad de realizar una importación, debe primero obtener una aprobación especial para importar sin API

 El registro API se divide en dos: API, para empresas comerciales. API para empresas manufactureras.

 Los bienes producidos en el exterior están clasificados en tres: Los bienes regulados, los bienes prohibidos y los bienes de libre importación. El Reglamento Nro. 54/M-DAG/PER/10/2009 sobre los requisitos generales de importación, y los requisitos específicos de importación para cada clasificación se encuentran a disposición de los importadores, en (www.kemendag.go.id)

 Luego de obtener el API o permiso de importación, se podrá gestionar para los importadores el Número de Registro de Importador (SPR). Como requisito previo se debe contar el número de identificación de aduanas (VIN), el trámite se realiza ante la Dirección General de Aduanas e Impuestos Especiales para conseguir NIK / SPR. A las empresas que no tienen NIK / SPR sólo se les permite realizar una importación por año y por vez.

 La decisión del Ministro de Finanzas Nº 453/KMK.04/ 2002 acerca de Procedimientos Aduaneros de Importación, modificado por el Decreto del Ministro de Finanzas Nº 548 / KMK.04 / 2002 (www.beacukai.go.id)

La atención a las PYME para estos trámites se puede realizar en las oficinas del ministerio de comercio en cada localidad.

Para las empresas que importan petróleo, gas y para las empresas que tienen inversionistas nacionales y extranjeros, la atención la realiza la Dirección General de Comercio Exterior y la Junta de Coordinación de Inversiones (BKPM). Los requisitos pueden encontrarse en la siguiente página: (www.kemendag.go.id)

Procedimiento de importación general

Los pasos del proceso de importación en Indonesia son los siguientes:

1. Los importadores deben buscar proveedores de bienes, de acuerdo a la conformidad con la importación.

2. Luego de acordar los términos de la importación, se puede generar un C/C u otro mecanismo de pago, adjuntar el PO de los bienes que serán importados. Los documentos y detalles de la importación deben estar de acuerdo a los términos establecidos en la C/C, para que el expediente salga limpio y sea fácilmente negociable.

3. Los bienes deben estar a disposición de embarque en el puerto de embarque de acuerdo a los términos negociados.

4. Importador recibirá del proveedor vía fax u otro medio toda la documentación requerida para la importación, factura B/L o AWB, lista de empaque, certificados de calidad y sanitarios, entre otros.

5. Los documentos originales se pueden enviar a través del Banco encargado de la cobranza o de acuerdo a los términos de venta negociados. Los pagos pueden ser pactados por adelantado, pagos parciales, pago a la llegada de la mercadería, crédito comercial etc. 6. Indonesia tiene un sistema mecanizado para el ingreso de los expedientes de importación

PIB. Si el importador cuenta con el módulo del PIB y el sistema de intercambio electrónico de datos, entonces el importador puede realizar esta operación directamente desde sus oficinas. Si no lo tiene debe ponerse en contacto con el PPJK (Servicios de despacho de aduana) para procesar el PIB y la posterior entrega del mismo.

7. Una vez creado al PIB de la importación, aparecerán registrados todos los derechos que se deben pagar PPH y otros impuestos. Los importadores deben incluir en el expediente físico todos los documentos requeridos para la importación de determinado producto.

8. Los pagos se pueden realizar en el sistema financiero con los bancos que tienen la autorización como entes recaudadores.

9. Banco enviara la información del pago vía el sistema informático (SKP) Aduanas e Impuestos Especiales en línea a través de los medios de comunicación Intercambio Electrónico de Datos (EDI)

10. Los datos del PIB serán procesados en el Portal de Indonesia Ventanilla Única Nacional (INSW) para la validación y verificación de documentos. De haber alguna observación esta será detectada en este proceso y se permitirá al importador realizar las correcciones necesarias.

11. Si hay errores, el PIB se devuelve al importador para las correcciones y volver a enviar los datos de PIB.

12. Una vez que el proceso se haya completado, los datos INSW PIB se envía automáticamente al sistema informático (SKP) de Aduanas e Impuestos Especiales.

13. El proceso de verificación tiene un sistema de colas que se maneja bajo la modalidad de semáforo.

14. Si PIB sale con luz verde, la Carta de Aprobación de Productos (SPPB), se emite inmediatamente.

15. Si PIB sale con luz roja se hará un proceso de control físico de las mercancías importadas por los funcionarios de Aduanas e Impuestos Especiales. Si el resultado de la verificación es correcto se emite la Carta de Aprobación del Productos (SPPB) si no entonces se aplicará las penalidades de acuerdo a las normas aplicables.

Algunas de las situaciones que obliga a hacer una inspección física de los documentos y mercancías, entre otros:

1. Importación nueva

2. Importador Perfil Alto Riesgo

3. Los bienes importados impuestas por el Gobierno 4. Importación Temporal de Mercancías

5. Operaciones Petroleras Productos (BOP) de clase II 6. No hay información de inteligencia / IPN

7. Expuestos a CAS / Aleatoria

8. Los bienes importados se incluyen en las mercancías de alto riesgo u originarios de países de alto riesgo

Nota: El importador puede seguir el estado de los documentos en tiempo real a través de un portal INSW mediante el registro del usuario. El proceso de obtener el usuario puede verse en el portal INSW (www.insw.go.id)

b) Licencias para la Importación de Productos de Horticultura

Los Importadores de productos de horticultura se clasifican en dos: IP Productos Horticultura e IT Productos Horticultura. IP son las importaciones que se realizan para ser utilizados por la Industria y el IT son las importaciones destinadas al comercio o venta. Las importaciones de productos de horticultura sólo pueden ser realizadas por una empresa que tiene los registros autorizados de IP Productos Horticultura o IT Productos Horticultura.

Para obtener la autorización como IP (comercio) Productos Hortícolas, la empresa debe aplicar por vía electrónica al ministerio de comercio a la Unidad de Coordinación del Comercio adjuntando:

 Licencia de negocio industrial u otro permiso similar, para el uso como materia prima de productos hortícolas

 Registro de la Empresa (TDP)

 Número de Identificación del Contribuyente (TIN)

 Productor Importador Número de Identificación (API-P)

 Evidencia de conocimiento sobre el manejo y almacenamiento según las características de los productos que importa.

 Evidencia de adecuadas características en el transporte de los productos

 Recomendación para importar productos de horticultura emitida por el Ministerio de Agricultura Indonesia.

 Carta de declaración jurada que indique que los productos no serán comercializados directamente a consumidores o minoristas.

Para obtener una autorización de IT (industria) para productos hortícolas, la empresa debe aplicar por vía electrónica al ministerio de comercio, Unidad de Coordinación del Comercio adjuntando:

 Licencia Comercial donde se especifique como giro del negocio la horticultura o la licencia de funcionamiento expedido por el organismo y los servicios técnicos autorizados

 Registro de Empresa (TDP)

 Número de Identificación del Contribuyente (TIN)

 Número de Identificación Importador general (API-T)

 Evidencia de conocimiento en el manejo y almacenamiento de productos hortícolas según las características de los bienes que importa.

 Evidencia de adecuadas características del transporte de productos hortícolas.

 Contratos de venta de productos de horticultura al menos tres (3) por distribuidor por lo menos por un periodo de 1 (un) año.

c) Aranceles a la Importación

Cálculo de los aranceles:

BM = (Precio CIF x NDPBM) x Tarifa

Nota:

Precio CIF: Costo de los bienes puesto en puerto Indonesio. Incluye valor de los bienes, costos de transporte, manipuleo, seguro y otros servicios.

NDPBM: Tipo de cambio fijado por el Ministro de Finanzas en forma periódica y se calcula para ciertas monedas extranjeras.

Tarifas: El porcentaje a pagar se determina de acuerdo con la clasificación de las mercancías contenidas en el libro de arancel aduanero de Indonesia

Se debe considerar adicionalmente el impuesto al valor agregado VAT que es el 10% y un pago a cuenta del impuesto a la renta de 2.5% si es importador registrado y sino la tasa es del 7.5%. Ejemplo de cálculo.

Impuestos que graven las mercancías importadas es el Impuesto al Valor Agregado (PPN) e Impuesto a la Renta (PPH). Método de cálculo es el siguiente:

PPN: aplicado sobre la base de la transferencia de bienes o servicios están sujetos al IVA del 10% PPH Ps.22: impuesto sobre la renta se aplica a la importación de mercancías desde el Departamento de Comercio.

BM: impuesto advalorem

MT = BM+PPN+PPH

PPN = 10% x (CIF x NDPBM + BM)

PPH según Articulo 22 = 2,5% x (BM + (CIFxNDPBM))

Para quien tiene registro de Importador API

PPH según Articulo 22 = 7,5% x (BM + (CIFxNDPBM))

d) Requisitos de Etiquetado de Productos Importados

 Desde 2014, de acuerdo a la Ley N ° 33 de 2014, los productos que circulan en Indonesia deben tener un certificado halal

El proceso de implementación para incluir todos los productos tomará 5 años. A la fecha para la fruta fresca que está ingresando a Indonesia solo se requiere poder una marca de que está apto para el consumo. Situación que se sustenta en los certificados GAP y HACCP así como el los certificados sanitarios y fitosanitarios.

 El etiquetado se hace de tal forma que no se separe fácilmente de la caja o del producto, no se dañe y sea fácil de ver y leer.

 Si la etiqueta no es posible colocarla en el producto porque es muy pequeño, entonces debe ser adherida al envase o colocada en aparte y unida al producto.

 También hay normas de etiquetado específicas, tales como:

Marcas para ahorro de energía en focos ahorradores (Reglamento Del Ministerio De Energía Y Recursos Minerales No. 06 De 2011).

Para lo que es tabaco se debe indicar los contenidos de alquitrán y nicotina, nombre y ubicación de la fábrica o del importador según sea el caso y la prohibición de venta a menores (Dirección General De La Circular De Aduanas E Impuestos Especiales Nº Se-39 / Ac / 2010 de 2010).

Alcohol indicar el contenido de alcohol y fecha de vencimiento.

Medicamentos tradicionales, medicamentos alternativos, medicina natural, alimentos y suplementos alimenticios (Reglamento Jefe BPOM Número Hk.03.1.23.06.10.5166 Año 2010), se debe indicar las fechas de vencimiento y fecha de producción de lote.

Para los productos químicos se utiliza el sistema globalmente armonizado de clasificación y etiquetado de productos químicos. (Reglamento Del Ministerio De Industria Nº 87 / M-Ind / Per / 9/2009.

e) Inspección y verificación de las importaciones. Examen físico:

 La inspección regular (P-07 / AC / 2007 sobre las importaciones de bienes y examen físico)

 Examen con Hi-Co herramienta de análisis de rayos X (KEP 97 / BC / 2003)

 Entidad encargada es la Dirección General de Aduanas e Impuestos Especiales

 El examen de campo / almacén de importadores (P-07 / AC / 2007 sobre las importaciones de bienes y Examen Físico)

Existen 4 niveles de examen físico:

 Alto - los artículos se inspeccionan al 100%

 Medio - 30% de los ítems son inspeccionados.

 Bajo - 10% de los bienes son inspeccionados.

 Muy bajos – los bienes son seleccionados en el almacén del importador ( Cuando el importador es seleccionado para el carril de prioridad)

Examen físico se realiza mediante la verificación de los productos de manera uniforme de acuerdo al % indicado de acuerdo al nivel que corresponde.

Para productos hortícolas y de acuerdo a la regulación del ministerio de comercio no. 16 en 2013, se debe realizar una verificación y evaluación técnica en el puerto de carga del país de origen por un agrimensor y debe incluir los siguientes datos:

 Estado y el puerto de origen de la carga

 La partida o el HS y descripción del producto

 Tipo y volumen

 Tiempo de Envío

 Puerto de Destino

 Inclusión en el envase de logo, tara, código de alimentos y reciclaje.

 Certificado de sanitario.

 Certificado fitosanitario para productos frescos hortícolas

 Certificado de envasado resultados de las pruebas de calidad alimentaria o una declaración del importador indicando que el embalaje utilizado está de acuerdo con las disposiciones legales, para los productos hortícolas frescos.

Nota: Para el caso del Perú la entidad encargada de esta certificación es SGS.

de cuotas a la importación de productos de horticultura ya no se usa, pero a través del sistema de licencias de importación previa en línea, se pretende hacer un proceso mas sencillo y ordenado para administrar las importaciones de manera mas segura. Es una medida ideada para proteger al productor local limitando la importación de productos del agro.

a) Registro del Producto (SPB y NPB) DESCRIPCIÓN DE NPB y SPB

 Todos los bienes importados que serán susceptibles de ser importados y que deben tener un SNI para ser tramitados en la zona de aduana deben contar con un Número de Registro de Productos (NPB), emitido por el centro para el Control de Calidad de Productos (PPMB) ministerio de comercio, este tiene una validez de tres (3) años, tiempo que puede ser ampliado. Se entregara una marca SIN para ser utilizada dentro del periodo de vigencia.

 Se debe solicitar un NPB por cada tipo de producto, que se importará

 Los productores deben indicar el NPB en cada artículo o paquete a ser importado. Las marcas que se deben imprimir en los empaques o bienes son las siguientes:

Explicación NPB (segunda fila):

1. Los tres primeros dígitos = número de registro LPK en la Dirección de Standarizacion 7. BARRERAS DE ENTRADA PARA LOS PRODUCTOS PERUANOS

2. Tres segundo dígitos = Código del país de origen de las mercancías

3. Cinco terceros dígitos = Las dos primeras cifras indican el año de emisión, los próximos cuatro dígitos de la serie número de registro de NPB.

b) Limitaciones en los puertos de ingreso para productos hortícolas.

Según la Regulación de Ministro de Agricultura de la Republica de Indonesia No. 15 y 16 del 2012, los puertos de entrada de los productos hortícolas son: Puerto de Belawan, Medan; Aeropuerto Internacional Soekarno Hatta, Jakarta; Puerto de Tanjung Perak, Surabaya; Puerto de Soekarno Hatta, Makassar y las Zonas de libre comercio.
