LEY QUE AUTORIZA AL PRESIDENTE DE LA REPÚBLICA PARA DICTAR DECRETOS CON
RANGO, VALOR Y FUERZA DE LEY EN LAS MATERIAS QUE SE DELEGAN.
El pasado martes 19 de Noviembre de 2013, fue publicado a través de Gaceta Oficinal No. 6.112, extraordinario, el decreto otorgado por la Asamblea Nacional de la República Bolivariana de Venezuela, sobre la “Ley que autoriza al Presidente de la República para dictar decretos con rango, valor y fuerza de ley en las materias que se delegan”, popularmente conocida como Ley Habilitante.
El contenido de la misma consta de 4 Artículos, en el cual, entre otras particularidades, autoriza al Presidente de la República, a dictar y/o reformar normas e instrumentos legales destinados a fortalecer los valores esenciales del ejercicio de la función pública, ello en aras de garantizar y proteger los intereses del Estado en sus Diferentes niveles de gobierno, especialmente en la lucha contra la corrupción y defensa de la economía; todo de acuerdo con el último aparte del artículo 203 y numeral 8 del artículo 236 de la Constitución de la República Bolivariana de Venezuela en los cuales se autoriza al Presidente de la República para que en Consejo de Ministros, dicte Decretos con Rango, Valor y Fuerza de Ley.

Igualmente se autorizó al Presidente de la República, para dictar entre otras normas principalmente las destinadas a profundizar y fortalecer los mecanismos de sanción penal, administrativa, civil y disciplinaria para evitar lesiones o el manejo inadecuado del patrimonio público y prevenir hechos de corrupción; normas contra la legitimación de capitales, combatir el financiamiento ilegal de los partidos políticos; establecer normas que eviten y sancionen la fuga de divisas, dictar y/o reformar normas que establezcan los lineamientos y estrategias para la planificación, articulación, organización y coordinación de los procedimientos, especialmente en materia de producción, importación, distribución y comercialización de los alimentos, materia prima y artículos de primera necesidad; así como normas para velar por la estabilidad monetaria de precios y el desarrollo armónico de la economía nacional; regular lo concerniente a las solicitudes de divisas a objeto de evitar el uso contrario para él fin solicitado, y, garantizar el derecho del pueblo a tener bienes y servicios seguros, de calidad y a precios justos.
La habilitación al Presidente de la República para dictar y/o reformar normas, tendrá un lapso de duración de doce (12) meses a partir de la publicación en la Gaceta Oficial de la República Bolivariana de Venezuela.

En el marco de esta habilitación, se promulgó la “Ley Orgánica para la Protección del Pueblo y sus Derechos Económicos”, la cual remitió al Tribunal Supremo de Justicia a los fines de darle carácter orgánico, tal y como lo indica la Ley que le otorga las referidas atribuciones en su artículo 2, en concordancia con el artículo 203 de la Constitución de la República.
Así, promulgó a su vez el “Decreto con Rango, Valor y Fuerza de Ley para la creación del Centro Nacional de Comercio Exterior y la Corporación de Comercio Exterior”.

ENABLING ACT THAT AUTHORIZES THE PRESIDENT OF THE BOLIVARIAN REPUBLIC OF
VENEZUELA TO DICTATE DECREES WITH THE FORCE OF LAW.
This past Tuesday, November 19th of 2013, the Official Gazette Number 6.112, a decree granted by the National Assembly of the Bolivarian Republic of Venezuela was published containing the “Enabling Act that authorizes the President of the Bolivarian Republic of Venezuela to dictate decrees with the force of Law”, commonly known as Enabling Act.
The Content is composed of 4 articles, and among them they provide the authorization for the President of the Republic to dictate or reform laws and other legal instruments destined to strengthen the essential values in the exercise of public functions in order to guarantee and protect the interests of the State in its different levels of government, especially in the fight against corruption and the defense of the economy. All of this, in accordance with the last part of the article 203 and the numeral 8 of the article 236 of the Constitution of the Bolivarian Republic of Venezuela, which authorizes the President of the Republic with the Council of Ministries to dictate Decrees with the Force of Law.

The President was also authorized to dictate, among other laws, those destined to deepen and strengthen the penal, administrative, civil and disciplinarian sanctions to avoid the inadequate use of public funds, the illegal financing of political parties and combat money laundering, while avoiding capital flight, reforming the norms that determine the guidelines and strategies for the planning, articulation, organization and coordination of the procedures, especially in the productive sector, for the importation, distribution and marketing of foods, raw materials and articles of first necessity; as well as the norms dedicated to safe guarding the monetary stability of prices and the harmonious development of the economy by regulating the request for foreign currency to avoid their incorrect use and guarantee the right of the people to have goods and services at affordable prices.
The enabling of the President of the Republic to dictate or reform laws will have a time period of 12 months starting from the day it is published in the Official Gazette of the Bolivarian Republic of Venezuela.

In the frame of this enabling act, the “Law for the Protection of the People and their economic rights” was sent to the Supreme Court of Justice in order to give it the value of organic law, in accordance with the enabling act in its article 2 and article 203 of the Constitution of the Republic.
At the same time, the “Decree with Force of Law for the Creation of the National Center for Foreign Commerce and the Corporation of Foreign Commerce” was dictated.
