Under Article 102 of the Charter of the United Nations every treaty and every international agreement entered into by any Member of the United Nations after the coming into force of the Charter shall, as soon as possible, be registered with the Secretariat and published by it. Further-more, no party to a treaty or international agreement subject to registration which has not been registered may invoke that treaty or agreement before any organ of the United Nations. The General Assembly by resolution 97 (I) established regulations to give effect to Article 102 of the Charter (see text of the regulations, Vol. 76, p. XVIII).

The terms "treaty" and "international agreement" have not been defined either in the Charter or in the regulations, and the Secretariat follows the principle that it acts in accordance with the position of the Member State submitting an instrument for registration that so far as that party is concerned the instrument is a treaty or an international agreement within the meaning of Article 102. Registration of an instrument submitted by a Member State, therefore, does not imply a judgement by the Secretariat on the nature of the instrument, the status of a party or any similar question. It is the understanding of the Secretariat that its action does not confer on the instrument the status of a treaty or an international agreement if it does not already have that status and does not confer on a party a status which it would not otherwise have.

Le Gouvernement du Royaume de Belgique et le Gouvernement de la Rpublique Socialiste Tch~coslovaque,

Anim~s du d~sir de d~velopper les transports routiers de voyageurs et de marchandises effectu~s entre les deux 1&tats, au moyen de v~hicules commer-ciaux, ainsi que le transit par leur territoire respectif, sont convenus de ce qui suit :

I. TRANSPORT DE VOYAGEURS PAR AUTOBUS ET AUTOCARS

TRANSPORTS SOUMIS AU R1AGIME DE L'AUTORISATION

Article 1

Tous les transports de voyageurs, par autobus ou par autocar, entre les deux pays ou en transit par leur territoire sont soumis au regime de l'autorisa-tion, sauf ceux qui sont d6finis k l'article 5.

Article 3

1. La demande d'autorisation doit 8tre adress~e aux autorit~s comp6tentes du pays d'immatriculation du v6hicule au plus tard deux mois avant la date pr~vue pour la mise en exploitation du service.

AGREEMENT' BETWEEN THE GOVERNMENT OF THE

KINGDOM OF BELGIUM AND THE GOVERNMENT OF

THE CZECHOSLOVAK SOCIALIST REPUBLIC

CON-CERNING INTERNATIONAL ROAD TRANSPORT

The Government of the Kingdom of Belgium and the Government of the Czechoslovak Socialist Republic,

Desiring to develop the road transport of passengers and goods between the two States, by means of commercial vehicles, as well as transit through their respective territories, have agreed as follows:

I. TRANSPORT OF PASSENGERS BY MOTOR BUS AND MOTOR COACH

TRANSPORT REQUIRING AUTHORIZATION

Article 1

All transport of passengers by motor bus or motor coach between the two countries or in transit through their territory shall require authorization, with the exception of the transport described in article 5.

REGULAR SERVICES

Article 2

1. Regular services between the two countries or in transit through their territory shall be approved by agreement and on a basis of reciprocity between the competent authorities of the two Contracting Parties.

2. The competent authorities of the Contracting Parties shall issue the authorization for the section of the route situated in their territory.

3. The competent authorities of the Contracting Parties shall, by agree-ment, establish the conditions under which the authorizations are issued.

Article 3

1. Each application for authorization shall be submitted to the competent authorities of the country in which the vehicle is registered, not later than two months before the date proposed for the inauguration of the service.

2. AUTRES TRANSPORTS

Article 4

1. Les autorisations pour les transports occasionnels de voyageurs autres que ceux vis~s h l'article 5 sont d~livr~es sur la base des demandes pr~sent~es l'Autorit6 comptente de la Partie contractante oii le v~hicule est immatricul6. Cette autorit6 les transmet h l'Autorit6 comptente de l'autre Partie contractante en vue d'approbation et de d6livrance d'autorisation.

2. 11 est d6livr6, pour chaque voyage et pour chaque v~hicule, une autori-sation individuelle qui couvre le trajet aller-retour, k moins que 'autoriautori-sation pr6cit~e n'en dispose autrement.

3. Chaque v~hicule doit avoir h bord l'autorisation d~livr~e par chacune des Autorit~s comptentes des Parties contractantes. Elle doit tre pr~sent~e h toute r6quisition des agents charges du contr6le.

TRANSPORTS NON SOUMIS k L'AUTORISATION

Article 5

1. Les entreprises de transport ayant leur siege d'exploitation dans l'un des deux pays et qui sont autoris~es h y assurer des transports occasionnels peuvent, sans autre autorisation, effectuer des transports sur le territoire de l'autre Partie contractante, ou en transit par ce territoire :

a) Lorsque le v6hicule a toujours h bord les memes voyageurs lors d'un seul

et m~me voyage, et ce depuis le lieu d'embarquement jusqu'au retour en ce lieu;

b) Lors d'un voyage dont le point de depart est situ6 sur le territoire du pays

d'immatriculation du v~hicule et le terminus sur le territoire de l'autre Partie contractante, condition que le v6hicule revienne h vide au pays

d'immatriculation;

2. The application shall be accompanied by the necessary documents (name or style of the carrier, the proposed time-table, fares and route, stopping points, information on the period of service during the year and on the expected starting date of operations, arrangements between carriers operating a joint service). In addition, the competent authorities of the Contracting Parties may request such other information as they deem appropriate.

3. The competent authorities of each Contracting Party shall transmit to the competent authorities of the other Contracting Party the applications which they intend to approve, together with all prescribed documents.

All authorizations shall be subject to the prior approval of the transit countries.

OTHER TRANSPORT

Article 4

1. Authorizations for occasional transport of passengers other than the transport referred to in article 5 shall be issued on the basis of the applications submitted to the competent authority of the Contracting Party in whose territory the vehicle is registered. The said authority shall forward them to the compe-tent authority of the other Contracting Party for approval and for the issue of the authorization.

2. Unless the above-mehtioned authorization provides otherwise, a separate round-trip authorization shall be issued for each journey and for each vehicle.

3. Each vehicle must carry the authorization issued by the competent authority of the Contracting Party concerned. The authorization must be produced at the request of the control authorities.

TRANSPORT NOT REQUIRING AUTHORIZATION

Article 5

1. Carriers having their head offices in either country and authorized to operate occasional transport services in that country may, without further authorization, provide transport service in the territory of the other Contracting Party, or in transit through that territory:

(a) When the vehicle carries the same passengers throughout a single journey,

from the boarding point until the return to that point;

(b) For a journey in which the point of departure is situated in the territory of the country in which the vehicle is registered and the terminus is in the territory of the other Contracting Party, provided that the vehicle returns empty to the country in which it is registered;

II. TRANSPORTS DE MARCHANDISES

TRANSPORTS SOUMIS k AUTORISATION Article 6

1. Tous les transports de marchandises entre les territoires des deux Parties contractantes ou en transit par leur territoire sont soumis au regime de l'autorisation, except6 les transports dont question k l'article 9 du present Accord.

2. Les Autorit~s comptentes de chaque Partie contractante fixent annuel-lement et d'un commun accord le contingent d'autorisations.

3. Elles remettent aux Autorit6s comptentes de l'autre Partie contractante le nombre convenu d'autorisations.

Article 7

Les autorisations de transport sont d6livr6es aux transporteurs par les Autorits comptentes du pays d'immatriculation du v~hicule.

Article 8

1. Les autorisations sont de deux esp~ces:

a) ( Autorisation h temps *, valable pour une dur&e qui ne peut exc6der une ann6e;

b) #Autorisation au voyage * valable pour un ou plusieurs transports et pour

une dur&e limite.

2. Le titulaire de l'autorisation est tenu de remplir avant chaque transport un compte rendu de transport.

3. L'autorisation et le compte rendu y an'nex6 doivent accompagner le v6hicule sur le parcours en territoire de l'autre Partie contractante et 6tre pr& sent6s h toute r6quisition des agents charg6s du contrble.

4. Par (s vhicule ), il faut entendre un v~hicule isolM ou un ensemble de v~hicules coupl6s.

5. L'autorisation est incessible.

6. Au retour, le transporteur peut charger des marchandises sur le

terri-toire de l'autre Partie contractante, destination du pays d'immatriculation du v~hicule.

(c) When the vehicle enters the territory empty for repairs.

2. In the case of the transport operations referred to in this article, the vehicle must carry a passenger list. Such list must be produced at the request of the control authorities.

II. TRANSPORT OF GOODS

TRANSPORT REQUIRING AUTHORIZATION

Article 6

1. All transport of goods between the territories of the two Contracting Parties or in transit through their territory shall require authorization, with the exception of the transport operations referred to in article 9 of this Agreement. 2. The competent authorities of each Contracting Party shall each year establish, by agreement, a quota for authorizations. '

3. They shall provide the competent authorities of the other Contracting Party with an agreed number of authorization forms.

Article 7

Transport authorizations shall be issued to carriers by the competent authorities of the country in which the vehicle is registered.

Article 8

1. Authorizations shall be of two types:

(a) " Time authorizations ", valid for not more than one year;

(b) " Journey authorizations ", valid for one or more transport operations and for a limited period.

2. The holder of the authorization shall be required to complete a trans-port retrans-port before each transtrans-port operation.

3. The authorization and the report attached to it must be carried in the vehicle on the section of the route situated in the territory of the other Con-tracting Party and be produced at the request of -the control authorities.

4. The term " vehicle " shall mean a single vehicle or a series of vehicles coupled together.

5. The authorization shall be non-transferable.

6. On the return journey the carrier may, in the territory of the other Contracting Party, pick up goods intended for the country in which the vehicle is registered.

c) Les transports de v~hicules endommag~s; d) Les transports effectu6s pour compte propre.

TRANSPORTS PLAC S HORS CONTINGENT

Article 10

Sont soumis h autorisation, mais places hors contingent:

a) Les transports de d6m~nagements assures au moyen de v6hicules

sp~ciale-ment am6nag6s h cet effet;

b) Les transports d'objets destines h des foires, i des expositions ou h des

demonstrations;

c) Les transports de chevaux de course, de v~hicules automobiles de course

et d'autres accessoires de sport h destination de manifestations sportives;

d) Les transports de d~cors et d'accessoires de theatre;

e) Les transports d'instruments de musique et de materiel destines aux

enre-gistrements radiophoniques et aux prises de vues cin~matographiques ou de tdl~vision;

f) Le transit.

Toutefois les transports vis~s aux litteras b h e ne peuvent ftre execut6s hors contingent que si les objets ou animaux sont ramen~s dans le pays d'im-matriculation du v~hicule.

STATISTIQUES

Article 11

Les donn~es statistiques h 6changer sont fix~es de commun accord par les Autorit~s comptentes des Parties contractantes.

III. DISPOSITIONS DOUANIMRES ET FISCALES

Article 12

Le traitement douanier des v6hicules et des marchandises est r6gl6 par les dispositions des conventions internationales auxquelles les deux Parties contrac-tantes sont li6es.

TRANSPORT NOT REQUIRING AUTHORIZATION

Article 9

No authorization shall be required for:

(a) The transport of human remains by vehicles specially equipped for the

purpose;

(b) The transport of articles by vehicles with a carrying capacity of less than

500 kilogrammes;

(c) The transport of damaged vehicles;

(d) Transport on own account.

TRANSPORT OUTSIDE THE QUOTA SYSTEM

Article 10

Authorization shall be required, but outside the quota system, for

(a) The removal of household effects by vehicles specially equipped for the

purpose;

(b) The transport of articles intended for fairs, exhibitions or displays; (c) The transport of racehorses, racing cars or other sports equipment intended

for sports events;

(d) The transport of stage scenery and properties;

(e) The transport of musical instruments and equipment for making radio

recordings and cinematographic or television films;

(f)

Transport in transit.

However, the transport operations referred to in sub-paragraphs (b) to (e) may be carried out on a non-quota basis only if the articles or animals are transported back to the country in which the vehicle is registered.

STATISTICS

Article 11

Any statistical data to be exchanged shall be determined by agreement between the competent authorities of the Contracting Parties.

III. CUSTOMS AND FISCAL PROVISIONS

Article 12

The customs treatment of vehicles and goods shall be governed by the provisions of the international conventions to which the two Contracting Parties have acceded.

Article 13

1. Les vghicules automobiles ainsi que les remorques de tous genres, immatriculgs rggulirement dans une des Parties contractantes et qui sgjournent temporairement sur le territoire de l'autre Partie contractante, sont exonr6s des imp6ts et taxes qui, sur le territoire de l'autre Partie contractante, frappent la circulation ou la d6tention des vghicules automobiles et des remorques. 2. L'exongration ne s'6tend ni aux droits de douane et de consommation, ni aux droits de pgage sur les routes et les ponts.

3. Les imp6ts et taxes pergus h l'occasion du transport r~mun6r6 de person-nes ou de marchandises sont r6gl6s entre les Autorit6s comptentes des Parties contractantes.

IV. DISPOSITIONS G] NtRALES

Article 14

Les transports de voyageurs et de marchandises, visas au pr6sent Accord, ne peuvent tre effectu~s que par les v~hicules immatricul~s dans une des Parties contractantes.

Article 15

1. Les transporteurs domicili~s sur le territoire d'une des Parties contrac-tantes ne sont pas autoris6s h effectuer des transports de voyageurs ou de mar-chandises entre deux points situ~s sur le territoire de l'autre Partie contractante. 2. Ils ne peuvent effectuer des transports de marchandises au d6part du territoire de l'autre Partie contractante destination d'un pays tiers et vice-versa.

Article 16

Les paiements qui doivent 6tre executes en vertu d'obligations d~coulant des dispositions du present Accord sont r~gl~s conform6ment a l'Accord de paiement en vigueur entre les deux Parties contractantes.

Article 17

Les transporteurs d'une des Parties contractantes peuvent, pour assurer les transports vis~s au pr6sent Accord, 6tablir un repr6sentant sur le territoire de l'autre Partie contractante, conform~ment h la r~glementation en vigueur dana ce pays.

Article 18

Lorsque le present Accord n'en dispose pas autrement, les l6gislations nationales des Parties contractantes sont applicables.

Article 13

1. Motor vehicles, as well as trailers of any kind, duly registered in the territory of one of the Contracting Parties and temporarily present in the territory of the other Contracting Party shall be exempt from the taxes and charges levied in the territory of the other Contracting Party on the operation or possession of motor vehicles and trailers.

2. The exemption shall not cover customs and excise duties or road and bridge tolls.

3. Taxes and charges to be collected in the case of paid transport of persons or goods shall be settled between the competent authorities of the Contracting Parties.

IV. GENERAL PROVISIONS

Article 14

The passenger and goods transport operations referred to in this Agreement may be carried out only by vehicles registered in the territory of one of the Contracting Parties.

Article 15

1. Carriers domiciled in the territory of one of the Contracting Parties shall not be authorized to engage in the transport of passengers or goods between two points in the territory of the other Contracting Party.

2. They may not engage in the transport of goods from the territory of the other Contracting Party to a third country, or vice versa.

Article 16

Payments which are to be made under obligations arising out of the pro-visions of this Agreement shall be settled in accordance with the Payments Agreement in force between the two Contracting Parties.

Article 17

Carriers of either of the Contracting Parties may, in order to ensure the transport services referred to in this Agreement, maintain a representative in the territory of the other Contracting Party, in accordance with the regulations in force in that country.

Article 18

Except where otherwise provided in this Agreement, the national legislation of the Contracting Parties shall apply.

COMMISSION MIXTE

Article 19

1. Les repr~sentants des Parties contractantes se r6unissent, en tant que de besoin, en Commission mixte pour assurer la bonne execution de l'Accord. 2. Les conclusions de la Commission mixte sont soumises, si n6cessaire, l'approbation des Autorit6s compkentes de chaque Partie contractante.

ENTR E EN VIGUEUR ET VALIDITI9

Article 21

1. Le present Accord entrera en vigueur h la date h laquelle les deux Partie contractantes se seront notifi6 que la procedure constitutionnellement requise en mati~re d'approbation a 6t6 accomplie.

2. II sera valable pour une duroe d'un an et sera prorog6 tacitement d'ann~e en annie, sauf d6nonciation par l'une des Parties contractantes, trois mois avant l'expiration de sa validit6.

MIXED COMMISSION

Article 19

1. Representatives of the Contracting Parties shall meet, when required as a Mixed Commission for the purpose of ensuring the proper application of the Agreement.

2. The findings of the Mixed Commission shall, if necessary, be submitted to the competent authorities of each Contracting Party for approval.

Article 20

Each Contracting Party shall inform the other Contracting Party which are the competent authorities authorized to settle questions relating to the application of this Agreement.

ENTRY INTO FORCE AND VALIDITY

Article 21

1. This Agreement shall enter into force on the date on which the two Contracting Parties are notified that the constitutionally required procedure for approval has been completed.

2. It shall be valid for a period of one year and shall be extended auto-matically from year to year unless denounced by one of the Contracting Parties three months before the expiry of its term.

CONVENIO RELATIVO AL APROVECHAMIENTO DE LOS

RAPIDOS DEL RIO URUGUAY EN LA ZONA DEL SALTO

GRANDE

El Excelentisimo sefior Presidente de la Repfiblica Argentina y el Excelen-tisimo sefior Presidente de la Repfiblica Oriental del Uruguay, animados del prop6sito de obtener el mayor beneficio de las disposiciones naturales que ofrecen los ripidos del rio Uruguay, en la zona del Salto Grande, para el desarrollo econ6mico, industrial y social de ambos paises y, con el fin de mejorar la navegabilidad, aprovechar sus aguas para la producci6n de energia y facilitar la vinculaci6n de sus comunicaciones terrestres, asi como cualquiera otro objeto que, sin menoscabo de los anteriores prop6sitos, concurra al enunciado beneficio comiin, han resuelto - en cumplimiento de lo establecido en el articulo 5 del Acta de trece de enero de mil novecientos treinta y ocho - celebrar el presente Convenio, y con tal fin han designado sus Plenipotenciarios, a saber:

sefior Doctor Don Gregorio N. Martinez, Su Embajador Extraordinario y Plenipotenciario en la Repilblica Oriental del Uruguay; y

El Excelentisimo sefior Presidente de la Repiblica Oriental del Uruguay : a los sefiores Doctor Don Eduardo Rodriguez Larreta, Su Ministro Secretario de Estado en el Departamento de Relaciones Exteriores; Don C6sar Mayo Guti6rrez, Su Ministro Secretario de Estado en el Departamento de Obras P6blicas y Doctor Don H6ctor Alvarez Cina, Su Ministro Secretario de Estado en el Departamento de Hacienda;

Quienes, despu6s de haber canjeado sus Plenos Poderes hallados en buena y debida forma, han convenido en lo siguiente:

Artculo 1

Las Altas Partes Contratantes declaran para los efectos del presente

Convenio, que las aguas del rio Uruguay serin utilizadas en com~in por partes

iguales.

Articulo 2

Las Altas Partes Contratantes acuerdan designar y mantener una Comisi6n T6cnica Mixta compuesta de igual nimero de delegados por cada pais, la que tendri a su cargo todos los asuntos referentes a la utilizaci6n, represamiento y derivaci6n de las aguas del rio Uruguay.

Los sueldos y gastos de los Delegados mencionados precedentemente, serin costeados por los Gobiernos respectivos.

Articulo 3

La Comisi6n T~cnica Mixta dictari su reglamento t~cnico administrativo y formulari su plan de trabajo, ajustando su cometido a las siguientes reglas y principios que las Altas Partes Contratantes acuerdan a este prop6sito :

a) Las diversas utilizaciones de aguas tendrin el siguiente orden de priori-dad y no se permitirA ninguna utilizaci6n que las estorbe o restrinja:

1) Utilizaci6n para fines dom~sticos y sanitarios; 2) Utilizaci6n para navegaci6n;

3) Utilizaci6n para producci6n de energia; 4) Utilizaci6n para riego.

Asimismo la Comisi6n solicitarA de los Gobiernos las medidas necesarias para la conservaci6n de la riqueza icticola.

b) Las decisiones de la Comisi6n T~cnica Mixta serfin tomadas por mayoria

de la totalidad de sus miembros. En caso de empate, las delegaciones harin in-formes por separado, cada una a su respectivo Gobierno. Las Altas Partes Contratantes tratarin de llegar a un acuerdo, y en tal caso el mismo se proto-colizari y comunicari a la Comisi6n T~cnica Mixta, la que proveeri lo necesario para su cumplimiento. En caso de no ponerse de acuerdo, las Altas Partes convienen en solucionar sus diferencias mediante procedimientos diplomditicos y si tampoco se hallare soluci6n por ese medio deberin ser sometidos al arbitraje.

c) La Comisi6n T6cnica Mixta dirigiri todas sus comunicaciones a los

Ministerios de Relaciones Exteriores de ambos paises, remiti~ndoles asimismo copia de todas sus actuaciones, dictimenes y cualquiera otra informaci6n que considere conveniente.

d) La Comisi6n, de acuerdo con sus necesidades, empleari personal

t6cnico y administrativo, permanente o temporario. Al efecto y salvo casos especiales, utilizard personal national de ambas Altas Partes Contratantes por partes iguales.

Artculo 4

Las obras e instalaciones en cominin, constituidas principalmente por la presa, con las instalaciones mecinicas y elctricas de generaci6n, asi como los estudios y proyectos, sern costeados por partes iguales.

Las obras no comunes constituidas principalmente por las de acceso, las complementarias, lineas de transmisi6n, asi como las indemnizaciones y expro-piaciones a realizar en el territorio de cada pais, serin por cuenta de los respecti-vos Gobiernos.

Las obras e instalaciones que se necesitaren para la navegaci6n, aguas arriba de la presa, serdn costeadas por cada pals proporcionalmente a su utili-zaci6n, teniendo en cuenta sus respectivas zonas de influencia, extensi6n del litoral fluvial y trifico probable.

El valor a asignarse a las obras e instalaciones en comin seri tal que permita producir energia a un costo no superior al que se podria obtener en una central t6rmica de la misma potencia, instalada en la zona de las obras. Si el monto de las obras e instalaciones en comin resultase superior al valor asi asignado, el exceso se sumard al costo de las obras destinadas a la navegaci6n.

Si la potencia total instalada fuera transitoriamente repartida entre las Altas Partes Contratantes en proporci6n distinta al 50%, las obras e instala-cionas en comfin serin costeadas, durante el periodo correspondiente, en pro-porci6n a las potencias parciales reservadas durante ese periodo por cada parte. Si al formularse el proyecto definitivo la Repblica Oriental del Uruguay reservara, para determinado periodo de tiempo, menos de la mitad de la potencia total instalada, la Repiblica Argentina tomarA el resto durante ese periodo y lo ird reintegrando al Uruguay de acuerdo con sus previsiones de consurno, debiendo mediar una notificaci6n hecha con cuatro afios de anticipaci6n para que se haga efectivo el reintegro correspondiente.

Cualquiera que sea la proporci6n en que contribuya cada una de las Altas Partes Contratantes, las obras e instalaciones en comin, pertenecerAn en con-dominio por partes iguales a los Estados signatarios al final del periodo de amortizaci6n.

Articulo 5

Las Altas Partes Contratantes acuerdan que el uso y derivaci6n, temporario o permanente, de las aguas del rio Uruguay y sus tributarios - aguas arriba de la presa - s6lo serAn otorgados por los Gobiernos en sus respectivas juris-dicciones, previo informe de la Comisi6n T6cnica Mixta.

Artlculo 6

La Comisi6n T6cnica Mixta dispondri la ejecuci6n de los estudios que faltare realizar en el momento de entrar en funciones y formulari los proyectos para la realizaci6n de las obras e instalaciones necesarias, los que con sus respectivos presupuestos, pliegos de condiciones, planes econ6micos y de financiaci6n y disposiciones aplicables sobre el r6gimen general de trabajo obrero, serin elevados para su consideraci6n y aprobaci6n, a las Altas Partes Contratantes.

Una vez obtenida esta aprobaci6n, la Comisi6n quedard facultada para Ilevar a cabo la ejecuci6n, recepci6n parcial y total de las obras e instalaciones a realizar.
