Esta documentación y los programas pertinentes (denominados conjuntamente “Software” en lo sucesivo) están protegidos por derechos de autor.

Los autores acogen con agrado cualquier información relativa a contenidos incorrectos u obsoletos a través de [email protected]

El Software se entrega únicamente en formato legible por máquina (formato de código objeto). En virtud de todos los derechos de propiedad intelectual que posee TELEVES, esta otorga por la presente al licenciatario un derecho no exclusivo a utilizar el Software. El derecho de utilización del Software se concede para un pe- ríodo de tiempo ilimitado, a menos que se disponga lo contrario. El licenciatario tendrá derecho a realizar una copia exclusivamente con fines de copia de seguridad personal (copia de respaldo). Salvo que la legislación establezca otra cosa, el licenciatario no tendrá derecho a modificar, desmontar, realizar labores de ingeniería inversa, descompilar o alterar de cualquier otro modo el Software en todo o en parte. TELEVES se reserva todos los derechos de propiedad intelectual, salvo los expresamente otorgados en virtud de la presente. El licenciatario no tendrá derecho a modificar o eliminar códigos alfanuméricos u otros códigos de identificación sobre soportes de datos, y transferirá dichos códigos de identificación a cualquier copia de respaldo que realice lícitamente. El licenciatario no tendrá derecho a transmitir cualquier información incluida en este documento sin contar con la autorización previa por escrito de TELEVES.

Las modificaciones del software propietario de TELEVES para su propio uso y la ingeniería inversa para la depuración de dichas modificaciones están permitidas en la medida en que dichos componentes de software estén vinculados a las bibliotecas de programas bajo la Licencia Pública General Menor de GNU (LGPL).

Sin embargo, se prohíbe la transmisión a terceros de los conocimientos adquiridos durante la ingeniería inversa o la depuración. Además, no se puede redistribuir la información obtenida de la reingeniería o del software modificado.

En el caso de que el licenciatario haya recibido el Software con fines no comerciales para utilizarlo con fines no comerciales y sin derecho a revenderlo (y es, por tanto, el usuario final), estará obligado a transmitir el derecho de utilización del Software a un tercero únicamente en relación con el producto adquirido por el licenciatario junto con el Software. Si el licenciatario transfiere el derecho de utilización del Software a un tercero, se asegurará de no otorgar a estos últimos derechos adicionales a los que originalmente le fueron otorgados a él, e impondrá al tercero las obligaciones derivadas de los presentes términos de licencia. En ese caso, el licenciatario no podrá conservar copia de respaldo alguna. El licenciatario no tendrá derecho a otorgar sublicencias. Si el licenciatario transmite el Software a un tercero, asumirá la responsabilidad que ello conlleve y eximirá a TELEVES del cumplimiento de las leyes y obligaciones de control de las exportaciones en la medida que proceda.

Si y en la medida en que TELEVES proporcione Software sobre el que únicamente se le haya concedido un derecho derivado de uso (Software de Terceros), serán de aplicación además (y prevalecerán) los términos de licencia de dicho Software de Terceros. Si se suministra Software de Código Abierto, serán de aplicación además (y prevalecerán) los términos de licencia del citado Software de Código Abierto. TELEVES proporcionará al licenciatario el correspondiente código fuente del Software de Código Abierto en cuestión, en el caso de que los términos de la licencia de este incluyan dicha obligación. TELEVES informará si el Software contiene Software de Terceros y/o Software de Fuente Abierta, y pondrá a disposición del licenciatario, a petición de este, los correspondientes términos de licencia.

Este Software ha sido elaborado con la máxima diligencia y se ha verificado que funciona correctamente de acuerdo con el actual estado de la técnica. TELEVES rechaza por la presente cualquier responsabilidad o garantía, expresa o tácita, relacionada con la calidad de este Software, su rendimiento o su adecuación para un fin específico que difiera de las especificaciones relativas a su rendimiento indicadas en la descripción del Software. TELEVES no será responsable de los daños que puedan producirse de forma directa o indirecta como consecuencia del uso del manual o del software relacionado. Tampoco será responsable de los daños incidentales o consecuentes, salvo en caso de negligencia grave o intencionada. TELEVES rechaza explícitamente cualquier responsabilidad derivada de las pérdidas o daños que sufran el hardware, el software o los datos en conexión con errores directos o indirectos o con su destrucción; tampoco será responsable de los daños (incluido el fraude) derivados de configuraciones deficientes o incorrectas (incluidas aquellas que no incluyan una protección suficiente –o de ningún tipo–

mediante contraseña) de las conexiones (incluidas, con carácter no limitativo, las de banda ancha, como el ADSL, el cable/DOSCSIS y la fibra óptica, así como las conexiones VoIP o SIP), ni de los costes (incluidos los gastos de conexión) relacionados con el Software suministrado o derivados de instalaciones incorrectas que no hayan sido efectuadas por TELEVES.

TELEVES no tendrá la obligación de ofrecer ningún tipo de servicio de software. La información que contiene este Software está sujeta a modificación sin previo aviso con fines de introducción de mejoras técnicas.

El software Open Source se distribuye con la esperanza de que resulte útil, pero SIN GARANTÍA ALGUNA, incluso sin la garantía tácita de COMERCIABILIDAD o ADECUACIÓN PARA UN FIN DETERMINADO.
