NOTICE OF BOND ELECTION
TO THE RESIDENT QUALIFIED VOTERS OF WICHITA COUNTY, TEXAS:
NOTICE IS HEREBY GIVEN THAT an election will be held within Wichita County, Texas, on Saturday, May 6, 2017, as provided in the order calling the election passed by the Commissioners Court of Wichita County, a substantial copy of which order is printed below:
ORDER CALLING A BOND ELECTION TO BE HELD ON MAY 6, 2017; PROVIDING FOR THE CONDUCT AND THE GIVING NOTICE OF THE ELECTION; AND ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT
WHEREAS, this Commissioners Court finds and determines that it is necessary and advisable to call and hold an election within Wichita County, Texas (the "County"), on the proposition hereinafter set forth; and
WHEREAS, it is further found and determined that the meeting at which this order was adopted was open to the public, and public notice of the time, place, and purpose of said meeting was given, all as required by Texas Government Code, Chapter 551; Now, Therefore
BE IT ORDERED BY THE COMMISSIONERS COURT OF WICHITA COUNTY, TEXAS:
Section 1. Election Ordered; Proposition. An election shall be held in Wichita County, Texas, on May 6, 2017, between the hours of 7:00 a.m. and 7:00 p.m., at which election the following proposition shall be submitted in accordance with law:
PROPOSITION
Shall the Commissioners Court of Wichita County, Texas, be authorized to issue the bonds of said County, in one or more series or issues, in the aggregate principal amount not to exceed $70,000,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the Commissioners Court, in accordance with law at the time of issuance, for the purpose of constructing and equipping public safety facilities consisting of a new jail and sheriff's offices, and shall said Commissioners Court be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient, within the limits prescribed by law, to pay the annual interest on the bonds and provide a sinking fund to pay the bonds at maturity?
Section 2. Polling Places. The election shall be held on election day at the polling places set forth in Exhibit A attached hereto and incorporated herein. Exhibit A shall be modified to include additional or different election day polling places designated by the County Elections Administrator.
Section 3. Early Voting. The Main Early Voting Polling Place, the Branch Early Voting Polling Places for conducting early voting by personal appearance, the dates and hours for early voting by personal appearance and the address for early voting by mail for said election are hereby designated as set forth in Exhibit B attached hereto. Exhibit B shall be modified to include additional or different early voting polling places designated by the County Elections Administrator.
Section 4. Election Officers. The persons to serve as election officers to conduct said election on election day and for early voting shall be appointed in accordance with the Texas Election Code (the “Code”). Lori Bohannon, Wichita County Elections Administrator, shall serve as early voting clerk for the election.
Section 5. Ballots. The official ballots for said election shall be prepared in accordance with the Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid PROPOSITION, with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITION to be expressed substantially as follows:

Section 6. Conduct of Election. In all respects, said election shall be conducted in accordance with the Code and all resident qualified electors of said County shall be permitted to vote in said election. Pursuant to the federal Help America Vote Act and the Code, each polling place shall be provided at least one voting system equipped for individuals with disabilities. Sufficient voting equipment to accommodate the voters shall be provided for early voting and at each of the polling places on election day.
Section 7. Notice of Election. Proper notice of said election shall be given in accordance with the Code.
Section 8. Debt Obligation Election Order. In accordance with the provisions of Section 3.009(b) of the Code, it is hereby found and determined that:
(a) The proposition language that will appear on the ballot is set forth in Section 5 hereof. (b) The purpose for which the bonds are to be authorized is set forth in Section 1 hereof. (c) The principal amount of the bonds to be authorized is set forth in Sections 1 and 5 hereof. (d) As set forth in Sections 1 and 5 hereof, if the bonds are approved by the voters, the Commissioners Court will be authorized to impose and levy annual ad valorem taxes, on all taxable property in the County, sufficient, within the limits prescribed by law, to pay the principal of and interest on the bonds.
(e) Based upon the bond market conditions at the date of adoption of this Order, the maximum interest rate for any series of the bonds is estimated to be 5.00% as calculated in accordance with applicable law. Such estimate is based on advice received from the County's financial advisor, which advice takes into account a number of factors, including the issuance schedule, maturity schedule and the expected bond ratings of the proposed bonds. Such estimated maximum interest rate is provided as a matter of information, but is not a limitation on the interest rate at which the bonds, or any series thereof, may be sold.
(f) As set forth in Section 1 hereof, if the bonds are approved, they may be issued in one or more series, to mature over a period not to exceed 40 years.
(g) The aggregate amount of the outstanding principal of the County's debt obligations secured by ad valorem taxes, as of the beginning of the County's 2016-2017 fiscal year, was $7,550,000.00.
(h) The aggregate amount of the outstanding interest on the County's debt obligations secured by ad valorem taxes, as of the beginning of the County's 2016-2017 fiscal year, was $834,620.30.
(i) The ad valorem debt service tax rate for the County for the 2016-2017 fiscal year is $0.0247 per $100 of taxable assessed valuation.
Section 9. Effective Date. In accordance with the provisions of Texas Government Code, Section 1201.028, this Order shall be effective immediately upon its adoption by the Commissioners Court.

POR EL PRESENTE SE AVISA que el sábado 6 de mayo de 2017 se celebrará una elección dentro del Condado de Wichita, Texas como se dispone en la orden que convoca a una elección aprobada por el Tribunal de Comisionados del Condado de Wichita, cuya copia sustancial se imprime a
continuación:
ORDEN QUE CONVOCA A UNA ELECCIÓN DE BONOS A CELEBRARSE EL 6 DE MAYO DE 2017; QUE DISPONE LA ADMINISTRACIÓN DE LA ELECCIÓN Y SU NOTIFICACIÓN; Y QUE PROMULGA OTRAS DISPOSICIONES RELACIONADAS CON EL TEMA.
VISTO que este Tribunal de Comisionados determina y declara que es necesario y aconsejable convocar y llevar a cabo una elección dentro del Condado de Wichita, Texas (el “Condado”) con respecto a la proposición que se establece a continuación; y
VISTO que además se determinó y declaró que la sesión en la cual esta orden fue aprobada estaba abierta al público, y que se dio aviso público acerca del horario, el lugar y el propósito de dicha sesión, todo como se requiere en el Capítulo 551 del Código de Gobierno de Texas; entonces, por lo tanto
EL TRIBUNAL DE COMISIONADOS DEL CONDADO DE WICHITA, TEXAS ORDENA:
Sección 1. Elección ordenada; proposición. El 6 de mayo de 2017, entre las 7:00 a.m. y las 7:00 p.m., se celebrará una elección en el Condado de Wichita, Texas en la que se someterá la siguiente proposición de acuerdo con la ley:
PROPOSICIÓN
¿Se autorizará al Tribunal de Comisionados del Condado de Wichita, Texas a emitir bonos de dicho Condado, en una o más series o emisiones, por un importe total de capital no superior a $70,000,000, y dichos bonos de cada serie o emisión, respectivamente, vencerán en serie a más tardar dentro de los 40 años de su fecha de emisión, y se venderán a los precios y devengarán interés a las tasas que se determinarán a criterio exclusivo del Tribunal de Comisionados, de acuerdo con la ley vigente al momento de la emisión, para la construcción y el equipamiento de instalaciones de seguridad pública, que consisten en una prisión y oficinas para el alguacil nuevas; y se autorizará a dicho Tribunal de Comisionados a imponer y a hacer que se evalúen y recauden impuestos ad valorem anuales en una cantidad suficiente, dentro de los límites dispuestos por la ley, para pagar el interés anual sobre los bonos y proveer un fondo acumulativo para pagar los bonos a su vencimiento?
Sección 2. Sitios de votación. La elección se celebrará el Día de las Elecciones en los sitios de votación establecidos en el Anexo A adjunto e incorporado a este documento. El Anexo A deberá modificarse para incluir sitios de votación adicionales o diferentes para el Día de las Elecciones designados por el Administrador de Elecciones del Condado.
Sección 3. Votación Adelantada. Como se establece en el Anexo B adjunto, por el presente se designa el Sitio Principal de Votación Adelantada, los Sitios de Votación Adelantada en Sucursales para llevar a cabo la Votación Adelantada en persona, las fechas y los horarios para la Votación Adelantada en persona y la dirección para la Votación Adelantada por correo para dicha elección. El Anexo B deberá modificarse para incluir sitios de votación adicionales o diferentes para la Votación Adelantada designados por el Administrador de Elecciones del Condado.
Sección 4. Funcionarios electorales. Las personas que sirven como funcionarios electorales para celebrar dicha elección el Día de las Elecciones y para la Votación Adelantada serán nombradas de conformidad con el Código Electoral de Texas (el “Código”). Lori Bohannon, Administradora de Elecciones del Condado de Wichita, actuará como Secretaria de Votación Adelantada para la elección.
Sección 5. Boletas. Las boletas oficiales para dicha elección se prepararán de acuerdo con el Código a fin de permitir que los electores voten “A FAVOR” o “EN CONTRA” de la PROPOSICIÓN anteriormente mencionada, y las boletas contendrán dichas disposiciones, marcas y lenguaje exigidos por la ley, y dicha PROPOSICIÓN deberá expresarse sustancialmente como sigue:

Sección 6. Administración de la elección. En todos los aspectos, tal elección se administrará de acuerdo con el Código, y todos los electores habilitados que residan en dicho Condado tendrán derecho a votar en la elección. De acuerdo con la Ley Ayude a América a Votar federal y el Código, cada sitio de votación dispondrá de por lo menos un sistema de votación dotado para personas discapacitadas. Se proveerán suficientes equipos de votación para acomodar a los votantes para la Votación Adelantada y en cada sitio de votación el Día de las Elecciones.
Sección 7. Aviso de Elección. Se deberá dar aviso apropiado de dicha elección de acuerdo con el Código.
Sección 8. Orden de elección y obligaciones de deuda. De acuerdo con las disposiciones de la Sección 3.009(b) del Código, por el presente se declara y determina que:
(a) El lenguaje de la proposición que aparecerá en la boleta se establece en la Sección 5 del presente.
(b) El propósito para el cual se autorizarán los bonos se establece en la Sección 1 del presente.
(c) El importe de capital de los bonos que se autorizará se establece en las Secciones 1 y 5 del presente.
(d) Como se establece en las Secciones 1 y 5 del presente, de ser aprobados los bonos por los votantes, se autorizará al Tribunal de Comisionados a imponer y recaudar impuestos ad valorem anuales
sobre todas las propiedades gravables en el Condado, dentro de los límites dispuestos por la ley, suficientes para pagar el capital y el interés sobre los bonos.
(e) Dada la condición del mercado de bonos prevalente a la fecha de adopción de esta Orden, la tasa de interés máxima para cualquier serie de los bonos se estima que será del 5.00%, calculada de acuerdo con la ley correspondiente. Dicha estimación se basa en el consejo recibido por parte del asesor financiero del Condado; consejo que considera varios factores, incluyendo el calendario de emisión, el calendario de vencimientos y la calificación prevista de los bonos propuestos. Dicha tasa de interés máxima estimada se provee con fines informativos, y no representa un límite en cuanto a la tasa de interés a la que se venderán los bonos, o cualquier serie de los mismos.
(f) Como se establece en la Sección 1 del presente, de ser aprobados los bonos, dichos bonos pueden emitirse en una o más series, y vencer durante un período que no sobrepasará los 40 años.
(g) El importe total del capital a pagar con respecto a las obligaciones de deuda del Condado, las cuales están aseguradas por impuestos ad valorem, al inicio del año fiscal 2016-2017 del Condado es de $7,550,000.00.
(h) El importe total del interés a pagar con respecto a las obligaciones de deuda del Condado, las cuales están aseguradas por impuestos ad valorem, al inicio del año fiscal 2016-2017 del Condado es de $834,620.30.
(i) La tasa de impuesto ad valorem para servicio de deuda del Condado para el año fiscal 2016-2017 es de $0.0247 por $100 de valoración catastral gravable.
Sección 9. Fecha de vigencia. De acuerdo con las disposiciones de la Sección 1201.028 del Código de Gobierno de Texas, esta Orden entrará en vigor de manera inmediata una vez adoptada por el Tribunal de Comisionados.
