ORDINANCE NO. 26421

An ordinance ordering a bond election to be held in the city of Dallas on November 7, 2006, for the purpose of authorizing general obligation bonds; prescribing the form of the ballot; designating polling places; providing for the use of an electronic voting system for early voting by personal appearance, a computerized voting system for early voting by mail, and electronic and computerized voting systems for voting on election day; permitting only resident qualified voters to vote; providing for early voting; providing for an early voting ballot board to process early voting; providing for notice of the election; and providing an effective date.

WHEREAS, the city council of the city of Dallas has determined that it is advisable that an election should be called for the purpose of submitting propositions for the issuance of general obligation bonds of the city for the purposes stated in the listed propositions; Now, Therefore,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DALLAS:

SECTION 1. That a bond election is ordered to be held in the city of Dallas on Tuesday, November 7, 2006, between the hours of 7:00 a.m. and 7:00 p.m., which date is not less than 15 days or more than 90 days from the effective date of this ordinance. At the election, the following propositions will be submitted to the qualified voters of the city:

PROPOSITION NO. 1

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $390,420,000 for the purpose of providing funds for permanent public improvements, to-wit: planning, designing, constructing, reconstructing, improving, extending, and expanding streets, thoroughfares, freeways, alleys, sidewalks, bridges, pedestrianways, trolleyways and other multi-modal transportation facilities, including related storm drainage facilities and improvements, signalization, signage, video roadside cameras, and other traffic and signal controls, streetlighting, landscaping, streetscape and median improvements, and the acquisition of land therefor; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

PROPOSITION NO. 2

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $334,315,000 for the purpose of providing funds for permanent public improvements, to-wit: planning, designing, constructing, renovating, repairing, replacing, and expanding flood protection and storm drainage facilities and improvements, including erosion control, flood management and storm drainage relief improvements, including the relocation of utilities and the acquisition of land therefor; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

PROPOSITION NO. 3

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $343,230,000 for the purpose of providing funds for permanent public improvements, to-wit: planning, designing, constructing, improving, renovating, repairing, replacing, expanding, equipping, and acquiring land for park and recreation facilities, including neighborhood parks, downtown parks, aquatic facilities, municipal golf facilities, trails, open space, playgrounds, park service and maintenance facilities, and facilities located at Fair Park, the Dallas Arboretum and the City Zoo; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $46,200,000 for the purpose of providing funds for permanent public improvements, to-wit: planning, designing, constructing, renovating, repairing, replacing, expanding, equipping, and furnishing library facilities and the acquisition of land or interests in land therefor; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

PROPOSITION NO. 5

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $60,855,000 for the purpose of providing funds for permanent public improvements, to-wit: planning, designing, constructing, renovating, repairing, replacing, expanding, equipping, furnishing and acquiring land for cultural arts facilities, including a performing arts theater in the Downtown Arts District; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

PROPOSITION NO. 6

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $34,750,000 for the purpose of providing funds for permanent public improvements, to-wit: planning, designing, constructing, renovating, replacing, repairing, expanding, equipping and furnishing city hall, city service and city maintenance facilities, including the acquisition of land therefor; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

PROPOSITION NO. 7

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $1,500,000 for the purpose of providing funds for permanent public improvements, to-wit: acquiring land under the land bank program for the development of low or moderate income single family homes; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

PROPOSITION NO. 8

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $41,495,000 for the purpose of providing funds for the following public purpose, to-wit: promoting economic development in the Southern area of the city, and promoting economic development in other areas of the city in connection with transit oriented development, through planning, designing, constructing, improving, extending and expanding public street, utility and other infrastructure facilities, including the acquisition of land therefor, and through funding the city’s programs for economic development including the acquisition of improved and unimproved properties, the demolition of existing structures, making loans and grants of bond proceeds and otherwise providing assistance for private commercial, industrial, retail, residential and mixed-use development; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

PROPOSITION NO. 9

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $6,635,000 for the purpose of providing funds for permanent public improvements, to-wit: planning, designing, reconstructing, improving, renovating, repairing, replacing, expanding and equipping facilities located at the Farmers Market, including the acquisition of land, relocation of utilities, street infrastructure improvements, sidewalks, storm drainage facilities and

controls, street lighting, streetscape and median improvements in connection therewith; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

PROPOSITION NO. 10

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $22,550,000 for the purpose of providing funds for permanent public improvements, to-wit: acquiring land in the area known as Cadillac Heights for the future location of police academy related facilities and/or city service and maintenance facilities; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

PROPOSITION NO. 11

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $7,945,000 for the purpose of providing funds for permanent public improvements, to-wit: planning, designing, constructing, renovating, repairing, replacing, expanding, equipping, and furnishing court facilities and the acquisition of land therefor; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

PROPOSITION NO. 12

Shall the city council of the city of Dallas, Texas, be authorized to issue general obligation bonds of the city in the aggregate principal amount of $63,625,000 for the purpose of providing funds for permanent public improvements, to-wit: planning, designing, constructing, renovating, repairing, replacing, expanding, equipping, and furnishing public safety facilities including police substations, a police academy and related facilities, fire stations, fire training and related facilities and emergency warning systems, and the acquisition of land therefor; said bonds to mature serially over a period not to exceed twenty (20) years from their date, to be issued in such installments and sold at any price or prices and to bear interest at any rate or rates as shall be determined within the discretion of the city council under laws in effect at the time of issuance, and to provide for the payment of the principal of and interest on said bonds by levying a tax sufficient to pay the annual interest on and to create a sinking fund sufficient to redeem said bonds as they become due?

SECTION 2. That electronic and computerized voting systems must be used for voting at and on the date of the bond election in compliance with the provisions of the Texas Election Code, as amended, and the vote must be upon an official ballot submitting the propositions in substantially the following form, so as to permit voters to vote "FOR" or "AGAINST" the propositions:

“THE ISSUANCE OF $390,420,000 GENERAL OBLIGATION BONDS FOR STREET AND TRANSPORTATION IMPROVEMENTS.”

PROPOSITION NO. 2

“THE ISSUANCE OF $334,315,000 GENERAL OBLIGATION BONDS FOR FLOOD PROTECTION AND STORM DRAINAGE FACILITIES.”

PROPOSITION NO. 3

“THE ISSUANCE OF $343,230,000 GENERAL OBLIGATION BONDS FOR PARK AND RECREATION FACILITIES.”

PROPOSITION NO. 4

“THE ISSUANCE OF $46,200,000 GENERAL OBLIGATION BONDS FOR LIBRARY FACILITIES.” PROPOSITION NO. 5

“THE ISSUANCE OF $41,495,000 GENERAL OBLIGATION BONDS TO PROMOTE ECONOMIC DEVELOPMENT IN THE SOUTHERN AREA OF THE CITY, AND IN OTHER AREAS OF THE CITY IN CONNECTION WITH TRANSIT-ORIENTED DEVELOPMENT, BY PROVIDING PUBLIC INFRASTRUCTURE AND FUNDING THE CITY’S ECONOMIC DEVELOPMENT PROGRAMS FOR SUCH AREAS.”

PROPOSITION NO. 9

“THE ISSUANCE OF $6,635,000 GENERAL OBLIGATION BONDS FOR FARMERS MARKET IMPROVEMENTS.” PROPOSITION NO. 10

“THE ISSUANCE OF $22,550,000 GENERAL OBLIGATION BONDS FOR ACQUISITION OF LAND IN THE CADILLAC HEIGHTS AREA FOR FUTURE LOCATION OF CITY FACILITIES.”

PROPOSITION NO. 11

“THE ISSUANCE OF $7,945,000 GENERAL OBLIGATION BONDS FOR COURT FACILITIES.” PROPOSITION NO. 12

“THE ISSUANCE OF $63,625,000 GENERAL OBLIGATION BONDS FOR PUBLIC SAFETY FACILITIES INCLUDING POLICE FACILITIES, FIRE FACILITIES AND EMERGENCY WARNING SYSTEMS.”

SECTION 3. That the manner of conducting the election must be in accordance with the ordinances and charter of the city of Dallas and the laws of the State of Texas applicable to the holding of bond elections. The official ballots, together with such other election materials as are required by the Texas Election Code, as amended, must be printed in both the English and Spanish languages and must contain such provisions, markings, and language as may be required by law.

SECTION 4. That the boundaries of the election precincts in which the election is to be held are defined by Ordinance No. 20231, as amended by Ordinance Nos. 20741, 21350, 21579, 22343, 22693, 23348, 24800, and 25696. Locations of the polling places in the respective election precincts in Dallas, Denton, and Collin Counties are as designated in Exhibit A, attached to and made a part of this ordinance by reference.

SECTION 5. That each voter must vote in the precinct in which the voter resides, and only resident qualified voters are entitled to vote.

SECTION 6. That a person qualified to vote and residing in the city of Dallas, but not within any precinct described in Ordinance No. 20231, as amended by Ordinance Nos. 20741, 21350, 21579, 22343, 22693, 23348, 24800, and 25696, may vote in the precinct nearest the person's residence, and for that purpose the person's residence will be considered as part of that city election precinct. A person who has registered in a city election precinct, but whose residence is not in the city of Dallas, is not entitled to vote in the bond election even though the person may own property subject to taxation in the city.

SECTION 7. That early voting by personal appearance will be by the use of an electronic voting system in accordance with the Texas Election Code, as amended. Early voting by mail will be by the use of a computerized voting system in accordance with the Texas Election Code, as amended. Early voting in Dallas, Denton, and Collin Counties will be conducted at the locations and during the dates and times designated in Exhibit B, attached to and made a part of this ordinance by reference.

• For Dallas County: Early Voting Clerk, Elections Department, 2377 Stemmons Freeway, Suite 820, Dallas, Texas 75207. • For Denton County: Denton County Elections Administration Office, P.O. Box 1720, Denton, Texas 76202.

• For Collin County: Collin County Elections Administration Office, 2010 Redbud Boulevard, Suite 102, McKinney, Texas 75609. Applications for ballots by mail must be received no later than close of business on Tuesday, October 31, 2006.

SECTION 9. That the early voting ballots will be processed by an early voting ballot board to be created in accordance with the Texas Election Code, as amended.

SECTION 10. That the mayor or, in the mayor's absence or inability to act, the mayor pro tem shall give notice of the bond election by causing a notice containing a substantial copy of this ordinance, in both English and Spanish, to be:

(1) published on the same day in each of two successive weeks in a newspaper of general circulation within the city, the date of the first publication to be not less than 14 days or more than 30 days before the election; and

(2) posted on the city's public meeting bulletin board and at three other public places within the city, not less than 21 days before the election.

SECTION 11. That this ordinance will take effect immediately from and after its passage and publication in accordance with the provisions of the Charter of the City of Dallas, and it is accordingly so ordained.

ORDENANZA Nº 26421

Ordenanza que manda la realización de unas elecciones de bonos en la Ciudad de Dallas, el 7 de noviembre de 2006, con el propósito de autorizar bonos de obligación general; prescribe la forma de la papeleta de votación; designa los sitios de votación; dispone el uso de un sistema electrónico de votación para la votación anticipada en persona, un sistema computarizado de votación para la votación anticipada por correo, y sistemas electrónicos y computarizados de votación para la votación el día de elecciones; permite que solamente voten los residentes calificados; dispone la votación anticipada; dispone que una junta de votación anticipada procese la votación anticipada; dispone la notificación de las elecciones; y dispone una fecha de entrada en vigencia.

CONSIDERANDO QUE: El ayuntamiento de la Ciudad de Dallas ha determinado que es aconsejable que se convoque a unas elecciones a fin de presentar proposiciones para la emisión de bonos de obligación general de la ciudad, para los efectos citados en las proposiciones mencionadas; por consiguiente:

EL AYUNTAMIENTO DE LA CIUDAD DE DALLAS DECRETA:

SECCIÓN 1. Que se ordene llevar a cabo unas elecciones de bonos en la Ciudad de Dallas, el 7 de noviembre de 2006, entre las 7:00 a.m. y las 7:00 p.m. Dicha fecha no está a menos de 15 días ni a más de 90 días de la fecha de entrada en vigencia de esta Ordenanza. En las elecciones se presentarán a los votantes calificados de la ciudad las siguientes proposiciones:

PROPOSICIÓN Nº 1

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $390,420,000, para efectos de proporcionar fondos para mejoras públicas permanentes, a saber: planificación, diseño, construcción, reconstrucción, mejoramiento, extensión y ampliación de calles, vías públicas, autopistas, callejones, aceras, puentes, vías peatonales, vías para trolebuses, y otras instalaciones de transporte multimodales, incluyendo: instalaciones y mejoras relacionadas con la canalización de aguas pluviales, señalización, videocámaras en carretera, y otros controles de tráfico y señales, iluminación de las calles, jardines, paisaje urbano y mejoras de las franjas centrales, y la adquisición de terrenos para ello; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

PROPOSICIÓN Nº 2

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $334,315,000, para efectos de proporcionar fondos para mejoras públicas permanentes, a saber: planificación, diseño, construcción, renovación, reparación, reemplazo y ampliación de instalaciones y mejoras para protección contra inundaciones y para la canalización de aguas pluviales, incluyendo: control de erosión, mejoras en los servicios de ayuda para gestión de inundaciones y canalización de aguas pluviales, incluyendo la reubicación de empresas de servicios públicos y la adquisición de terrenos para ello; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

PROPOSICIÓN Nº 3

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $343,230,000, para efectos de proporcionar fondos para mejoras públicas permanentes, a saber: planificación, diseño, construcción, mejoramiento, renovación, reparación, reemplazo, ampliación, equipamiento y adquisición de terrenos para instalaciones de parques y recreación, incluyendo parques de vecindario, parques en el centro de la ciudad, instalaciones acuáticas, campos municipales de golf, caminos, espacios abiertos, parques infantiles, instalaciones para servicio y mantenimiento de parques, e instalaciones localizadas en Fair Para, el Jardín Botánico de Dallas y el Zoológico de la ciudad; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

PROPOSICIÓN Nº 4

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $46,200,000, para efectos de proporcionar fondos para mejoras públicas permanentes, a saber: planificación, diseño, construcción, renovación, reparación, reemplazo, ampliación, equipamiento y amoblado de instalaciones para bibliotecas, y la adquisición de terrenos o propiedades inmobiliarias para ello; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

PROPOSICIÓN Nº 5

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $60,855,000, para efectos de proporcionar fondos para mejoras públicas permanentes, a saber: planificación, diseño, construcción, renovación, reparación, reemplazo, ampliación, equipamiento, amoblado y adquisición de terrenos para instalaciones destinadas al arte y la cultura, incluyendo un teatro de artes escénicas en el Distrito de Arte del Centro de la Ciudad; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

PROPOSICIÓN Nº 6

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $34,750,000, para efectos de proporcionar fondos para mejoras públicas permanentes, a saber: planificación, diseño, construcción, renovación, reemplazo, reparación, ampliación, equipamiento y amoblado de las instalaciones del ayuntamiento y de las instalaciones de servicio y mantenimiento de la ciudad, incluyendo la adquisición de terrenos para ello; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $1,500,000, para efectos de proporcionar fondos para mejoras públicas permanentes, a saber: adquisición de terrenos bajo el programa de banco de tierras, para el desarrollo de viviendas unifamiliares para personas de ingresos bajos o moderados; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

PROPOSICIÓN Nº 8

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $41,495,000, para efectos de proporcionar fondos para el siguiente propósito público, a saber: la promoción del desarrollo económico en la zona sur de la ciudad, y la promoción del desarrollo económico en otras zonas de la ciudad en conexión con el desarrollo concebido en función de las necesidades del tránsito, a través de la planificación, diseño, construcción, mejoramiento, extensión y ampliación de calles públicas, e instalaciones de servicios públicos y otra infraestructura, incluyendo la adquisición de terrenos para ello, y a través de la financiación de los programas de la ciudad para desarrollo económico, incluyendo la adquisición de propiedades mejoradas y no mejoradas, la demolición de estructuras existentes, el otorgamiento de préstamos y subsidios usando el producto obtenido de los bonos, y, aparte de eso, el suministro de asistencia para el desarrollo privado comercial, industrial, comercial minorista, residencial y de usos mixtos; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $6,635,000, para efectos de proporcionar fondos para mejoras públicas permanentes, a saber: planificación, diseño, reconstrucción, mejoramiento, renovación, reparación, reemplazo, ampliación y equipamiento de las instalaciones localizadas en el Farmers Market (Mercado de abastos), incluyendo: adquisición de terrenos, reubicación de servicios públicos, mejoras en la infraestructura de las calles, aceras, instalaciones y controles para canalización de aguas pluviales, iluminación de las calles y mejoras en el paisaje urbano y en la franja central relacionadas con lo anterior; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

PROPOSICIÓN Nº 10

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $22,550,000, para efectos de proporcionar fondos para mejoras públicas permanentes, a saber: adquisición de terrenos en la zona conocida como Cadillac Heights para la futura ubicación de instalaciones relacionadas con la academia de policía y/o de instalaciones de servicio y mantenimiento de la ciudad; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $7,945,000, para efectos de proporcionar fondos para mejoras públicas permanentes, a saber: planificación, diseño, construcción, renovación, reparación, reemplazo, ampliación, equipamiento y amoblado de instalaciones del juzgado y la adquisición de terrenos para ello; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

¿El ayuntamiento de la Ciudad de Dallas, Texas, deberá ser autorizado para emitir bonos de obligación general de la ciudad por la suma total de capital de $63,625,000, para efectos de proporcionar fondos para mejoras públicas permanentes, a saber: planificación, diseño, construcción, renovación, reparación, reemplazo, ampliación, equipamiento y amoblado de instalaciones de seguridad pública, incluyendo subestaciones de policía, una academia de policía e instalaciones relacionadas, estaciones de bomberos, instalaciones para capacitación de bomberos e instalaciones relacionadas, y sistemas de alerta de emergencia, y la adquisición de terrenos para ello; y dichos bonos madurarán en serie durante un período que no debe sobrepasar los veinte (20) años a partir de su fecha, para ser vendidos en dichos plazos y a cualquier precio o precios y para devengar intereses a cualquier tasa o tasas, como quedará determinado a criterio del ayuntamiento de la ciudad, bajo las leyes vigentes en el momento de la emisión, y para disponer el pago del capital y de los intereses de dichos bonos por medio de la recaudación de un impuesto que sea suficiente para pagar el interés anual y para crear un fondo de amortización suficiente para pagar dichos bonos cuando se venzan?

Que deben utilizarse sistemas electrónicos y computarizados de votación para votar el día de elecciones de bonos, en conformidad con las disposiciones del Código Electoral de Texas, según sus enmiendas, y el voto debe hacerse en una papeleta de votación oficial que presente las proposiciones de la siguiente manera, para permitir que los votantes voten “A FAVOR” o “EN CONTRA” de dichas proposiciones:

“LA EMISIÓN DE BONOS DE OBLIGACIÓN GENERAL POR $63,625,000 PARA INSTALACIONES DE SEGURIDAD PÚBLICA, INCLUYENDO INSTALACIONES DE POLICÍA, INSTALACIONES DE BOMBEROS Y SISTEMAS DE ALERTA DE EMERGENCIA”.

SECCIÓN 3. Que las elecciones deben llevarse a cabo conforme a las ordenanzas y al fuero de la Ciudad de Dallas y a las leyes del Estado de Texas, aplicables a la celebración de las elecciones de bonos. Las papeletas oficiales de votación, junto con los demás materiales para elecciones exigidos por el Código Electoral de Texas, según sus enmiendas, deben imprimirse tanto en inglés como en español, y deben contener dichas disposiciones, marcas e idiomas como la ley lo exige.

SECCIÓN 4. Que los límites de los distritos electorales en los cuales se llevarán a cabo las elecciones son definidos por la Ordenanza Nº 20231, según enmiendas de las Ordenanzas Nº 20741, 21350, 21579, 22343, 22693, 23348, 24800 y 25696. La ubicación de los sitios de votación en los respectivos distritos electorales de los Condados de Dallas, Denton y Collin es la designada en el Anexo A, adjunto e incorporado a esta Ordenanza a modo de referencia.

SECCIÓN 5. Que cada votante debe votar en el distrito en el cual reside, y sólo los residentes calificados tienen derecho a votar.

SECCIÓN 6. Que una persona calificada para votar, residente en la Ciudad de Dallas, pero que no vive en ninguno de los distritos electorales descritos en la Ordenanza Nº 20231, según enmiendas de las Ordenanzas Nº 20741, 21350, 21579, 22343, 22693, 23348, 24800 y 25696, puede votar en el distrito más cercano a su residencia, y para estos efectos la residencia de la persona se considerará parte del distrito electoral de esa ciudad. Una persona que se ha registrado en un distrito electoral de la ciudad, pero cuya residencia no se encuentra en Dallas, no tiene derecho a votar en las elecciones de bonos, aunque dicha persona sea dueña de propiedad sujeta a tributación en la ciudad.

SECCIÓN 7. Que la votación anticipada en persona se realizará usando un sistema electrónico de votación de acuerdo con el Código Electoral de Texas, según sus enmiendas. La votación anticipada por correo se realizará usando un sistema computarizado de votación de acuerdo con el Código Electoral de Texas, según sus enmiendas. La votación anticipada en los Condados de Dallas, Denton y Collin se llevará a cabo en los sitios, fechas y horas designados en el Anexo B, adjunto e incorporado a esta Ordenanza a modo de referencia.

SECCIÓN 8. Las solicitudes para obtener papeletas de votación anticipada, que se usarán para votar por correo, deben enviarse por correo a las siguientes direcciones:

• Para el Condado de Dallas: Early Voting Clerk, Elections Department, 2377 Stemmons Freeway, Suite 820, Dallas, Texas 75207.

Las solicitudes para obtener papeletas de votación por correo deben recibirse a más tardar a la hora de cierre de los negocios, el martes 31 de octubre de 2006.

SECCIÓN 9. Que las papeletas de votación anticipada serán procesadas por una junta de votación anticipada, que se creará conforme al Código Electoral de Texas, según sus enmiendas.

SECCIÓN 10. Que el alcalde, o en su ausencia o incapacidad para actuar, el alcalde interino, notificará sobre las elecciones de bonos, por medio de un aviso que contenga, en forma sustancial, una copia de esta Ordenanza, tanto en inglés como en español, el cual será:

(1) publicado el mismo día de la semana, durante dos semanas consecutivas, en un periódico de circulación general de la ciudad; y la primera publicación debe hacerse a no menos de 14 días ni a más de 30 días de llevarse a cabo las elecciones; y

(2) fijado en el tablero de anuncios de reuniones públicas de la ciudad y en otros tres lugares públicos dentro de la ciudad, a no menos de 21 días de llevarse a cabo las elecciones.

SECCIÓN 11. Que esta Ordenanza entrará en vigencia inmediatamente después de su aprobación y publicación, conforme a las disposiciones del Fuero de la Ciudad de Dallas, y, en consecuencia, queda así decretado.
