PROJECT PURPOSE AND BACKGROUND
The construction contract for this project has been executed and the contractor for this project is FSC II, LLC, dba Fred Smith Company. A professional engineering firm will be responsible for managing the contract for the remaining intersection (sites 1, 2 and 3).
SCOPE OF WORK
This inspection of this intersection will be administered by the Town of Cary and should be completed by the end of January 2018. The Respondent shall submit six (6) copies of their proposal in a sealed envelope/box along with one digital version of the proposal (in PDF format) in the submission to the Town. Provide a minimum of three (3) references outside the Town of Cary related to similar projects.
Include a proposed timeline for completion of key tasks in each phase and the method and person responsible for ensuring the schedule and city budget are met. A demonstrated understanding of the City of Cary's project processes, working with external entities and external agencies necessary to project performance will be considered. The City will place significant weight on the individual qualifications of the project team members, who will do the majority of the work on the project.
The town will review the proposals and all the information provided in the submission package. Respondents deemed competitive by the Town may be asked to attend an interview and must make themselves available for a presentation of their proposal to the selection committee. The selected firm will be notified by the City and will enter into contract negotiations for the receipt of this work.
All proposal packages and materials presented below become the exclusive property of the Town of Cary. All submissions may be retained by the City and may be disclosed to third parties at the City's discretion. Appendix A contains the City's "Draft" standard Professional Services Agreement that will serve as the basis for any contract with the selected Consultant.
The Consultant is expected to (a) provide all tools, equipment, supplies, supervision, transportation and other performance accessories, services and facilities; (b) supply all specified and required materials, supplies and equipment to be incorporated into and form a permanent part of the completed work; (c) supply and carry out all necessary work; and (d) in accordance with good engineering practice, with due diligence, and in accordance with the requirements, terms, conditions and conditions of this document and the contract arising therefrom, carry out and complete all specified work to the satisfaction of the Municipality. It is disclosed or provided to the municipality in connection with a bid or proposal; And. The municipality will only withhold the file if both conditions have been met to the satisfaction of the municipality.
The City shall be entitled to deduct from payments to the Professional any costs or damages incurred or likely to be incurred by the City as a result of the failure of the Professional to perform any stage or task, after reasonable notice and an opportunity to cure such failure. from Professional. In the event that the City determines that any portion of an invoice is not acceptable, it shall identify to the professional the portion or portions that are not acceptable and shall pay the portion or portions of the invoice that are acceptable, if any. Professional will provide the City with all documents and materials in electronic form in MS-Windows compatible read-only format (including screen-readable .pdf or HTML formats).

Only questions submitted via email will be considered and answered (please include the RFP name and project number in the email subject line).
The issuance of such written responses is the only official method by which interpretation, clarification or additional information will be provided by the City.
PROPOSAL SUBMITTAL FORMAT AND CONTENTS
Please include the RFP name and project number (if available) in the subject line of the email. Make suggestions for potential additional services that can add value and/or impact the overall economy and efficiency of the project. Project Team(s): Provide an organizational chart of the project team that lists the dedicated project manager, key personnel and subconsultants assigned to the team, and the availability of back-up personnel to support this project.
Include a brief summary identifying roles and responsibilities and general qualifications (i.e. professional registrations, certifications and/or licenses) of each team member (including subconsultants) in disciplines appropriate to the Project, as well as education, availability to work on this Project, experience, years of experience (with current firm and other firms). Please do not list permanent staff who do not work directly on the project team. Insurance and Contract Statement: Provide a statement that the firm will provide insurance as specified in Appendix A – Draft Professional Services Agreement and provide a copy of the current Certificate of Insurance (not to be included in page count).
Cost proposal: Provide hourly rates for the project team members listed in the proposal.
EVALUATION METHOD
Consultants must identify all legal proceedings, administrative claims or fines to which the Consultant has been a party within the past five (5) years. Include any fines imposed by a governmental entity in connection with the proposed work in this RFP, such as fines by the EEOC, Department of Labor, or another governmental entity. The project manager's previous and/or current experience working with urban projects will be taken into account.
Schedule: Company's ability to meet schedules and responsiveness to City of Cary staff will be considered. Each company will be responsible for all costs (eg travel and presentation materials) associated with the presentation. If an agreement cannot be reached with the selected consultants, the City will negotiate with another qualified firm(s).
The City expects initial approval of the selected consultant in December 2017 and a target to begin work in January 2018 after negotiating a final professional services agreement.
MINIMUM REQUIREMENTS FOR CONTRACT EXECUTION
The Advisor is fully responsible for all costs incurred in developing and submitting this submission. Documents received by the City of Cary in response to a request for bids or request for proposals are public documents and subject to public inspection and reproduction. If the consultant submits as part of the consultant's bid or proposal to the municipality any document or part of a document that the consultant considers to be a trade secret that meets the definition in G.S.
66-152, and the reasons therefor, and (2) to indemnify the Town if a challenge is brought to the withholding of a record based on Consultant designating it as a trade secret. The Town will consider the request and may or may not accept the new personnel changes. A copy of this template (without instructions and comments) must be attached to all RFPs so that each person submitting a proposal will know the Town's expected contract terms.
The invoice must be in a form acceptable to the City and must show the services performed in the completion of the phase or task. Professional insurance companies must be licensed and admitted to do business in the state of North Carolina. Each policy shall provide that the City shall receive at least thirty (30) days prior written notice of any cancellation, non-renewal or reduction of coverage of any policy.
To the fullest extent permitted by law and regulation, Professional will indemnify and hold Town, its officers and employees harmless from all claims, costs, charges, civil penalties, fines, losses, liabilities and damages (including but not limited to all Professional ). ' fees and charges and all court or arbitration or other dispute resolution costs) incurred or alleged by anyone arising out of or related to the infringement of patent rights, copyrights or other intellectual property rights, except with respect to designs, processes or products of a specific manufacturer that the city specifically requests in writing. If Expert has reason to believe that the use of a requested design, process or product infringes a patent, copyright or other intellectual property, Expert shall be liable for such loss unless such information is promptly provided to the City. If Professional provides such authenticated and sealed information as described above, it shall be compensated in accordance with this Agreement.
Any approval by the Town may be granted with certain stipulations, such as the Town's participation in the creation of the public product or the Town's review and the option to reject the final release of the final product if it fails to meet the Town's standards and goals. To support these values, the Town has published Working with the Town of Cary—A Guide for Temporary Employees, Contractors, Consultants and Volunteers. In the event that the Professional notices any error in the electronic data provided to the City under this Agreement, the Professional shall immediately notify the City and, if the Professional has provided such electronic data, the Professional shall immediately replace it with the correct version thereof. .
Where any provision of this Agreement requires the giving of written notice, it will be deemed to have been validly given if (i) delivered personally to the Project Manager, if to the City, or to the Project Manager, or equivalent, or officer/member from the entity that is the professional, if to the professional, or (ii) if delivered to or shipped by a nationally recognized overnight courier or express mail or registered or certified mail, postage prepaid, to the municipality or professional's address. The City may provide copies of such documents, including copyrighted documents, in response to public records requests, except that the City, upon request and indemnification by the professional, will not disclose any document that meets all the requirements of a trade secret as set forth in NCGS Such electronic document of this Agreement shall be deemed an original signed Agreement for all purposes.
