Fees and expenses of the arbitrator shall be shared equally by the Council and the Union. The right to proceed to the arbitration step of this procedure is limited to the Union. Necessary forms for the submission of grievances shall be mutually agreed upon by the Union and the Council.

Costs incurred in the printing, supply and required distribution of such forms shall be shared equally by the Union and the Council. Replacement costs incurred as a result of seven (7) such days will be borne by the Council. Except for paragraph 3 above, the cost of substitute(s) incurred as a result of such leave is at the expense of the Union.

Written procedures will be developed that are mutually acceptable to the Board and the Union. At the same time, a copy of such material will be provided to the client and sent via courier or US. One (1) copy of the printed minutes of the board will be provided to the union free of charge when said material is made available to the board. .

Such selection shall be made by the President of the Union within seven (7) calendar days after receiving this list. Expenses incurred by the Board as a result of such deductions shall be borne by the Board. The amount of such consumption of materials and supplies must be immediately notified in writing to the Principal.

All reports and forms required by the board to be completed must be completed on paid time. Upon release, the employee must be notified of the same to the extent permitted by law. The length of such leave shall be at least half (1/2) of the employee's assigned work day, unless otherwise authorized by the supervisor.

Payment as provided herein shall be included in the affected employee's first regular paycheck of the following regular work year. Application for such leave must be submitted in writing on a form which must be provided by the Council with the reasons therefor to the principal or head of department. The length of such leave shall not exceed the balance of the financial year in which the leave began.

This statement and any other statements provided by the employee's physician are provided solely at the employee's expense.

The Board shall provide to each eligible employee, at no cost to the employee, group term life insurance in an amount equal to the annual salary of the employee as reflected in the salary schedule of this Agreement. The amount that such insurance cover can be increased in any insurance year will be limited to one (1) times the annual salary of the employee. If the teacher concerned is a member of the sick leave bank, this section will come into effect after the bank benefits have been exhausted.

These adjustments are included in the first viable salary upon submission of the appropriate documentation and are retroactive to the current fiscal year's earnings date. Upon POTA's written authorization, the Board will deposit the entire or specified amount of POTA's net salary into POTA's bank account. Beginning with the 2004/2005 school year, the POTA Board will provide an opportunity for annual payment for sick leave days accrued during the school year, provided such payment is conditioned on exemplary POTA attendance during the school year as reflected in the District's payroll records .

Payment for such exemplary attendance shall be calculated at eighty percent (80%) of the daily rate of the affected POTA, times ten (10) days. Payment as provided herein shall be made as soon as payroll procedures reasonably permit, but not later than July 1 of the year in which the application is made. The time and place for the purposes of negotiations are set by mutual agreement of the parties.

Neither party in any negotiations shall have any control over the selection of the bargaining representatives of the other party, provided that the Union shall not select any employee of the Council who is not a POTA and the Council shall not don't choose This Agreement may be changed or amended only with the voluntary mutual consent of the parties in writing and executed in full as an amendment to this Agreement. The Union recognizes and agrees to abide by those provisions of the Florida Statutes that prohibit work stoppages and thus provide penalties.

Any previously adopted rule or regulation of the Board of Directors that conflicts with any provision of this Agreement will be superseded by the applicable provisions of this Agreement. Notification of the intention to consider such policy and the Union's response thereto must be completed within the requirements of the Administrative Procedures Act. It is understood and agreed that all functions, rights, powers or authority of the governing body of the school district and of the school board, not specifically limited by the express language of this Agreement, shall be retained by the board and the board, provided, however, that such right may not be exercised in any manner that violates any of the specific provisions of this Agreement.

This agreement is effective until midnight on the day immediately preceding the first day of the start of the 2006-2007 POTA work year. In case of inconsistency between this addendum and the Summary Plan Description (SPD), the provisions of the EPPD shall prevail. THIS SECTION IS INTENTIONALLY LEFT BLANK).
