Heavy฀ vehi฀cle฀ dri฀vers฀ cove฀red฀ by฀ the฀ Act฀ respecting฀ owners, operators฀and฀drivers฀of฀heavy฀vehicles,฀and฀dri฀vers฀of฀a฀taxi฀or emer฀gen฀cy฀vehi฀cle฀are฀requi฀red฀to฀฀inform฀the฀per฀son฀res฀pon฀si฀ble฀for the฀vehi฀cle, or฀the฀owner฀of฀the฀taxi฀or฀emer฀gen฀cy฀vehi฀cle,฀when their฀ driver’s licen฀ce฀ (or฀ class฀ of฀ licen฀ce)฀ has฀ been฀ modified,฀ sus-pended฀or฀revoked.

LENGTH OF PENAL฀TY

A฀per฀son฀whose฀driver’s฀licen฀ce฀has฀been฀revo฀ked฀or฀the฀right to฀ ฀obtain฀ one฀ sus฀pen฀ded฀ due฀ to฀ an฀ accu฀mu฀la฀tion฀ of฀ deme฀rit

• a฀per฀son฀who฀holds฀a฀class฀5฀or฀6A฀learner’s฀licen฀ce฀and who฀does฀not฀yet฀hold฀a฀driver’s฀licen฀ce;

When฀ a฀ licen฀ce฀ has฀ beco฀me฀ sub฀ject฀ to฀ a฀ penal฀ty฀ resul฀ting from฀ the฀ accu฀mu฀la฀tion฀ of฀ deme฀rit฀ ฀points,฀ 4฀ or฀ 15฀ ฀points฀ are writ฀ten฀off฀the฀offen฀ding฀driver’s฀฀record,฀depen฀ding฀on฀the฀type of฀licen฀ce.฀However,฀any฀deme฀rit฀฀points฀that฀฀exceed฀these฀num฀bers will฀฀remain฀on฀the฀฀record฀for฀2฀years.

For฀ exam฀ple,฀ for฀ a฀ licen฀ce฀ hol฀der฀ who฀ has฀ accu฀mu฀la฀ted฀ 14 deme฀rit฀฀points,฀a฀sub฀se฀quent฀offen฀ce฀will฀bring฀that฀num฀ber฀to฀16.

Since฀the฀15฀point฀level฀has฀been฀rea฀ched,฀the฀driver’s licen฀ce฀is revo฀ked฀ and฀ 15฀ ฀points฀ are฀ era฀sed.฀ The฀ remai฀ning฀ deme฀rit point฀ stays฀ on฀ the฀ driver’s฀ ฀record฀ for฀ 2฀ years฀ fol฀lo฀wing฀ the

฀latest฀convic฀tion.

No฀฀points฀are฀writ฀ten฀off฀upon฀rene฀wal฀of฀a฀driver’s฀or฀learner’s licen฀ce,฀nor฀upon฀the฀issue฀of฀a฀first฀licen฀ce,฀or฀of฀a฀new฀licen฀ce fol฀lo฀wing฀revo฀ca฀tion.

D^EMERIT฀POINTS AND A RES฀TRIC฀TED LICEN฀CE

A฀dri฀ver฀whose฀licen฀ce฀has฀been฀sus฀pen฀ded฀or฀revo฀ked฀as฀a

฀result฀of฀a฀first-time฀accu฀mu฀la฀tion฀of฀deme฀rit฀฀points฀in฀2฀years (4฀ ฀points฀ for฀ pro฀ba฀tio฀na฀ry฀ licen฀ce,฀ or฀ 15฀ deme฀rit฀ ฀points฀ for฀ a driver’s฀ licen฀ce)฀ may฀ ฀obtain฀ a฀ res฀tric฀ted฀ licen฀ce฀ where฀ his/her live฀li฀hood฀requi฀res฀the฀ope฀ra฀tion฀of฀a฀motor vehi฀cle.฀To฀฀obtain฀a res฀tric฀ted฀licen฀ce,฀the฀per฀son฀must฀apply฀to฀a฀Court฀of฀Québec judge฀for฀a฀res฀tric฀ted฀licen฀ce฀and฀noti฀fy฀the฀Société฀of฀the฀appli฀ca฀-tion.฀ The฀ appli฀cant฀ has฀ to฀ prove฀ that฀ dri฀ving฀ is฀ an฀ essen฀tial

฀aspect฀of฀his/her฀work฀and฀peti฀tion฀the฀judge฀to฀฀obtain฀the฀order autho฀ri฀zing฀him/her฀to฀hold฀a฀res฀tric฀ted฀licen฀ce.
