Ingingo ya 109: Inshingano z’Inama
The guardianship council is composed of three (3) representatives from the paternal family,three (3) representatives from the maternal family and civil status registrar of the minor’s domicile.
Members of the family council are chosen among adults having close relationships with the minor and taking an interest in him/her, and with such integrity that can ensure the wellbeing of the child. Where the minor has adult brothers and sisters, they are automatically members of the council of guardianship, whatever their number may be.
When parents or parents in-law of either side are in an insufficient number, the civil status registrar calls upon either citizens known for having had relations with any parent of the minor, or if not available, the person taking care of the minor or persons of integrity of the domicile or residence of the minor.
Article 109: Responsibilities of the
Le conseil de tutelle est composé de trois (3) représentants de la famille paternelle et trois (3) représentants de la famille maternelle ainsi que l’officier de l’état civil du domicile du mineur.
Les membres du Conseil de tutelle sont choisis par le conseil de famille parmi les personnes majeures proches parents du mineur et portant intérêt au mineur et dont la moralité garantit la bonne éducation de celui-ci. Si le mineur a des frères et sœurs majeurs, ils sont d’office membres du conseil de tutelle, quel que soit leur nombre.
Lorsque les parents ou alliés de l’une ou l’autre ligne se trouvent en nombre insuffisant, l’officier de l’état civil appelle soit des citoyens connus pour avoir eu des relations habituelles d’amitié avec le père ou la mère du mineur. A défaut de ceux-ci, l’officier de l’état civil appelle la personne protectrice de ce mineur ou les personnes intègres du domicile ou de la résidence du mineur.

Responsibilities of the guardianship council are the following:
1° adminstration and evaluation the excercise of responsibilities of guardianship;
2° considering and granting the right to sale or mortgaging of the property of the minor with the aim of attending to the minor’s needs;
3° terminating the responsibilities of a guardian and replacing him/her in case of failure to fufill his/her responsibiliteis;
4° handing over the property of the minor once he/she attains majority age or after he/she has been emancipated.
In order to fulfil its mission as provided for in paragraph One of this Article,the council of gurdianship may atleast once in a year request a guardian to give accountability of his/her management and make an

Article 110: Meetings of the guardianship council
The Guardianship Council shall be headed by the civil status registrar or his/her representative.
Meetings of guardianship council are held at least once in a year and any other time it may be deemed necessary. Meetings are convened by the president upon his/her own initiative or on the request of one of the members, the minor or any other interested person.
The guardianship council can only convene if two thirds (2/3) of its members are present. If the quorum fails to be convene, the meeting shall be postponed. The following meeting shall sit and deliberate regardless of the number of members present.
Decisions of the guardianship council are taken by a two thirds (2/3) majority of the members present. In case of a tie, that of

Article 111: Child in State care
Minors who do not have any guardian become children in State care or in care of the orphanage that received them for the time being families to accommodate have are yet to be found.
The procedure for such guardianship shall be determined by an order of the minister in charge of family.
B. Guardian
Article 112: Requirements to become a guardian
A guardian must be an adult of atleast 21 years, of importance to the minor and whose moral integrity guarantees the monor’s good upbringing. This obligation

Article 113: Appointing a guardian The surviving spouse has a right to appoint a guardian in a will. The guardian appointed must, before starting his/her duties, notify this will to the civil status registrar in order to issue a guardianship certificate.
In case of notorious incapacity, the surviving spouse can appoint or approve a guardian from his or her family or outside the family in a guardianship deed made by a civil status registrar; this deed takes effect immediately.
In case of death, absence, disapperance of parents or deprivation of parental authority, guardianship is determined by guardianship council. The latter shall make a choice of an adult having interest in the child and with moral integrity that assure the right upbringing of the child.

Article 113 : Nomination du tuteur Le dernier survivant des parents dispose d’un droit de désignation d’un tuteur dans un testament. Le tuteur désigné doit, avant de commencer à assumer ses responsabilités, signifier ce testament à l’officier de l’état civil en vue d’établissement d’un acte de tutelle. Le dernier survivant des parents peut, en cas d’inaptitude manifeste, nommer et faire confirmer un tuteur parent ou étranger à la famille dans un acte de tutelle dressé par l’officier de l’état civil. Cet acte produit des effets immédiats.
En cas de décès, d’absence, de disparution des parents ou de déchéance de l’autorité parentale des deux parents, la tutelle est déférée par le conseil de tutelle. Le conseil de tutelle choisit une personne majeure portant intérêt au mineur et dont la moralité garantit la bonne éducation de celui-ci.

Article 114: Guardianship for a child in a receiving family
Guardianship is granted to a foster when a minor has been residing there for at least two (2) years on a permanent basis. The civil status registrar is duly informed of the guardianship by receiving parent, minor, local authorities or any interested person. However, a child of over the age of twelve (12) may oppose the guardianship.
Before his/her appointment as a guardian, the receiving parent assures preservation and administration of the minor’s property.
Article 115: Persons incapable of becoming guardians
The following persons are incapable of becoming guardians:
1° Minors;
2° incapable persons as declared by courts;
Article 114: Tutelle d’un mineur placé dans une famille d’accueil
La tutelle s’acquiert de plein droit lorsqu’un enfant mineur vient de passer, de façon continue, au moins deux (2) ans dans une famille d’accueil. Article 115 : Personnes interdites d’assurer la tutelle
Les personnes suivantes sont interdites d’assurer la tutelle:

3° Persons or their parents having been involved in court proceedings with that minor;
4° Persons deprived of civil rights;

Article 116: Inventory of minor´s property
When a guardian commences his/her duties he/she makes an inventory of the immovable and movable property of the minor in presence of the guardianship council.
A document containing nature and inventory is signed by the guardian and the members of guardianship council. A copy must be submitted to the civil status registrar within a period of thirty (30) days in order to be certified and attached to the guardianship deed.

Article 117: Inventory necessitated by the minor’s property modification
Every time there is an increase in property of the minor under guardianship, a supplementary inventory is made in conformity with the foregoing Article.
Article 118: Powers of a guardian
A guardian exercises right of safeguard to a minor. The latter cannot live in onother home without the consent of the guardian.
The guardian is bound to take care of the minor and contribute to his/her education depending on the property of the minor and interests arising therefrom. If the minor does not have any property, his/her education and other basic needs are at the guardian’s expenses within his/her means. Article 119: Powers of a guardian

Le tuteur exerce le droit de garde sur la personne du mineur. Le mineur ne peut aller vivre ailleurs qu’avec l’assentiment du tuteur.
Le tuteur est tenu de pourvoir à l’entretien et à l’éducation du mineur compte tenu des biens et des revenus tirés de tels biens. Si le mineur est dépourvu de biens, le tuteur pourvoit à son entretien et à son éducation dans les limites de ses ressources.

Ingingo ya 121: Ibikorwa byo gutanga
A guardian has the responsibility of representing a minor in acts relating to other persons.
He administers the property of the minor in a parental way and he liable for the poor administration of the property.
His/her power of administration does not encroach on the professional incomes realised out of the minor’s personal activity which is not related to the one of the guardian, as well as on the assets of property acquired through these incomes. However the guardian may give him/her advice on the management of that property.
Article 120: Preservatory and managerial actions of the guardian A guardian does all about preservation and administration in pursuance of the minor’s interests and in pursuit interest from the property.
Article 121: Acts relating to alienation
Le tuteur représente le mineur dans les actes de la vie civile.
Il administre les biens de la personne placée sous tutelle en bon père de famille et est personnellement responsable du préjudice occasionné par sa mauvaise gestion.
Le tuteur n’est pas compétent pour administrer les revenus professionnels que le mineur tire d’une activité distincte de celle du tuteur ainsi que les biens acquis par le tuteur grâce à ces revenus.
Toutefois, le tuteur peut, à tout moment, donner conseil au mineur quant à la gestion des dits revenus.
