8.2. METODOLOGÍA PARA EL DESDOBLAMIENTO DE COMPLEJIDAD
The Comptrollerof PublicAccountsproposes amendmentsto §19.12,concerningapplication;§19.13,concerningdefinitions; §19.14,concerningutilitymanagementplanning; §19.16,con- cerninglongrangeutilityservicesplan;and§19.17,concerning utilitybillreview.
The proposed amendment to §19.12 implementsthe require- mentsofGovernmentCode,§447.009regardingenergyandwa- termanagementplanningandreportingbyclarifyingtherespon- sibilitiesandreportingrequirementsforProvidingAgenciesand TenantAgencies.
The proposed amendment to §19.13 updates the definitions toreflectchangesmadein othersectionsof Chapter19. The proposed amendment adds the definitions of "Energy and WaterManagementPlan,""Providingagency,""SECO,""Tenant agency,"and"Utilityconsumptiondata,"andremovesdefinitions thatarenolongerusedinthischapter.
The proposed amendment to §19.14 implementsthe require- mentsofGovernmentCode,§447.009regardingenergyandwa- termanagementplanningandreportingbyrenamingthissection as "Energy and WaterManagement Plan," replacingthe "Re- sourceEfficiencyPlan"withthe"EnergyandWaterManagement Plan,"andoutliningthesubmissionandimplementationrequire- mentsfortheplan.
The proposed amendment to §19.16 implementsthe require- mentsofGovernmentCode,§447.009regardingenergyandwa- termanagementplanningandreportingbyremovingtherequire- menttosubmittheLongRangeUtilityServicesPlantotheState EnergyConservationOffice(SECO)andrequiringSECOtopost guidelinesfortheplanonitswebsite. Italsoremovesduplica- tivelanguagebydeletingtheterm"StateEnergyConservation Office."
The proposed amendment to §19.17 implementsthe require- mentsofGovernmentCode,§447.009regardingenergyandwa- termanagement planningandreportingby requiringagencies to reportutilityconsumption data, and directingagencies and institutionstoprepareand submitthedatain accordancewith theguidelineslocatedonSECO'swebsitebyOctober1ofeach year.Theamendmentalsoremovestherequirementthat"each stateagencyorinstitutionofhighereducationreviewandaudit utilitybillingsandcontractstodetectbillingerrors"becausethis requirementisalreadystatedinGovernmentCode,§447.007(c). Theamendmentalsorenamesthesection"UtilityConsumption DataReporting."
TomCurrah,ChiefRevenueEstimator,hasdeterminedthatfor thefirstfive-yearperiodtherulewillbeineffect,therewillbeno significantrevenueimpactonthestateorunitsoflocalgovern- ment.
Mr.Currahalsohasdeterminedthatforeachyearofthefirstfive yearstheruleisineffect,thepublicbenefitanticipatedasaresult ofenforcingtherulewillbeconformingSECOrulestocurrentlaw and to currentenergyperformance standards. The proposed amendmentwouldhavenofiscalimpactonsmallbusinesses. Thereisnosignificantanticipatedeconomiccosttoindividuals whoarerequiredtocomplywiththeproposedrule.

The amendments are proposed under Government Code, §447.002(b),which authorizesSECOto"establishprocedures andadoptrulesrelatingtothedevelopmentandimplementation of energy and water conservation measures and programs applicabletostatebuildingsandfacilities."
The amendmentsimplement GovernmentCode, Chapter447 (StateEnergyConservationOffice).
§19.12. Application.
(a) These [Unless specified otherwise, these] rules apply [generally]to allstateagenciesand institutionsofhigher education [that occupy state-owned buildings or that otherwise incur utility costs].
(b) Providingagencyreportingrequirements. Astateagency orinstitutionof highereducation thatoccupies ormanages astate- ownedbuildingandisresponsiblefortheprovisionofutilitiesshall: [Responsibilitiesofstateagencies.Allstateagenciesthatoccupystate- ownedbuildingsarerequiredtodevelopaResourceEfficiencyPlan.]
(1) have theprimaryresponsibility fordevelopmentand implementation of anEnergy and Water Management Plan; [State agenciesresponsibleforprovisionofutilities. Astateagencythatis responsiblefortheprovisionofutilitiesthatareusedinbuildingsor facilitiesofotherstateagenciesshallhavetheprimaryresponsibility fordevelopmentandimplementationoftheResourceEfficiencyPlan, withtheassistanceoftheusingagency.]
(2) develop a Long Range Utility Services Plan; and [Usingagencies.Anystateagencythatoccupiesspaceinastate-owned buildingto whichamanagingstateagencyprovides the utilityser- viceshall developaResourceEfficiencyPlan, tailoredtothe using agency'suniquesituation. Theusingagencyshallassistandsupport the managing agencyin the preparation and implementation of the managingagency'sResourceEfficiencyPlan. Theusingagencyshall coordinateits ResourceEfficiency Planwith the managingagency. The using agency shall cooperate with SECO and the managing agencytoaddressutilitymanagementinthebuilding.]
(3) report utility consumption data to SECO. [Leased space. Astateagencythatoccupiesabuildingthatthestatedoesnot ownshalldevelopaResourceEfficiencyPlan,tailoredtotheunique situationofthelessee,andshallcooperatewithSECOinaddressing the utilitymanagementofthatleasedspace. Thiscooperation shall includetakingactionsto affectenergyand wateruseand employee behaviortotheextentthatsuchactionscanresultinsavingsinutility related leasecosts. A stateagency that occupies non-state owned buildingsshall prepare theUtility AwarenessPlanthatis described in§19.14(c)(5)ofthistitle(relatingtoUtilityManagementPlanning) andupdatetheplanasrequired.]
(c) Tenantagencyreportingrequirements. Astateagencyor institutionofhighereducationthat occupiesabuildingmanagedby anotherpartyandisnotresponsibleforbuildingrenovationprojects shall:[Responsibilitiesofinstitutionsofhighereducation.]
(1) developanEnergyandWaterManagementPlan;[State fundedfacilities. Aninstitutionofhighereducationthatoccupiesa state-ownedbuildingshalldevelopaResourceEfficiencyPlanforits statefundedfacilities.]
(2) if the tenant agency occupies space of a providing agency, provide assistance in developing the Energy and Water Management Plan of the providing agency; and [Non-state funded (auxiliary) facilities. An institution of higher education may ask SECOfortechnicalguidancetoassistanyoftheinstitution'sauxiliary enterprisesinutilitymanagementtotheextentthattheassistancemay resultinapublicbenefit.]
(3) ifthetenantagencyhasaccesstoutilityconsumption data,reporttheutilityconsumptiondatatoSECO.[Leasedspace.An institutionofhighereducationthatoccupiesabuildingthatthestate doesnot own shall cooperate with SECO in addressingthe utility managementoftheleasedspace.Thiscooperationshallincludetaking actionstoaffectenergyandwateruseanduserbehaviortotheextent thatsuchactions canresultin savingsin utilityrelatedlease costs. An institution of higher education that occupies non-state owned buildingsshall preparethe UtilityAwarenessPlan thatisdescribed in§19.14(c)(5)ofthistitle(relatingtoUtilityManagementPlanning) andupdatetheplanasrequired.]
§19.13. Definitions.
Thefollowingwordsandterms,whenusedinthischaptershallhave thefollowingmeanings,unlessthecontextclearlyindicatesotherwise. (1) Energyand WaterManagement Plan--Acomprehen- siveplanpreparedbyastateagencyorinstitutionofhighereducation thatincludesaprogressreportofutilityreductionmeasures,goalsfor reducingutilityconsumption,astrategyandimplementationschedule, adescriptionofmethodsoffinancingimprovements,andanemployee awarenessplan. [Availablefunding--Anyfundsthatareappropriated forutilityefficiencyimprovementsorrelatedcapitalupgrades,repairs, maintenance,andoperationsofutilitysystems;fundsthatwouldor- dinarilybeallocatedtopayforutilityexpenses;andfundingfroma financingmethodthatisprescribedbyGovernmentCode,§2166.406.] [(2) Comprehensiveproject--Allutilityrelatedfacilityand operationalimprovementswhich,whenconsideredtogether,cancost effectivelybeimplementedatonetime.]
[(3) Costeffectivemeasure--Efficiencymeasuresthatin- dividuallyorasagroupcreatemeasurableandverifiableutilitycost savingsthatareatleastasgreatastheircostwithintheirusefullife,not toexceed15years.]
[(4) Five-yearEnergy ManagementPlan--A comprehen- siveplanthatconsistsofaResourceEfficiencyPlanandaLongRange UtilityServicesPlan.]
(2) [(5)]Institutionofhighereducation--Hasthemeaning thatisassignedbyEducationCode,§61.003.
(3) Providing agency--A state agency or institution of highereducationthatoccupiesormanagesastate-ownedbuildingand isresponsibleforpayingutilitybills.
(4) SECO--TheComptrollerofPublicAccountsStateEn- ergyConservationOfficeorlegallydesignatedsuccessor.
[(6) Managingstateagency--Astateagencythatisrespon- siblefortheprovisionofutilitiesusedinthebuildingsorfacilitiesof otherstateagencies.]
[(7) PreliminaryEnergyAudit--Anoverviewoffacilityen- ergyandwateruseincludinganexaminationofutilitybillsconducted duringawalkthroughofthefacilityandbriefinterviewsofagencyfa- cilitypersonneldesignedtoidentifypotentialcosteffectiveenergyand waterconservationmeasures.]
[(8) Resourceefficiencymeasure--Anycosteffectivemea- surethatisdesignedtoreduceutilityconsumptioncostsandrelated operatingcostsofgovernmentalfacilities.]
[(9) ResourceEfficiencyPlan--Acomprehensivebiennial planthatastateagencyorinstitutionofhighereducationpreparesand thatidentifiespotentialcosteffectivemeasuresforminimizingutility consumptionandcostsinallagencyfacilitiesandbuildings,alongwith implementationschedulesandmethodsoffinancingthemeasuresas outlinedinthischapter.]
[(10) Resource Efficiency Plan completion certification document--adocumentsubmittedbyastateagencyorinstitutionof highereducationtotheStateEnergyConservationOffice(SECO),in aformatspecifiedbySECO,indicatingthattheagencyorinstitution hascompletedorupdateditsResourceEfficiencyPlan,andthePlan isavailableforreviewbySECO.]
(5) [(11)] State agency--Any department, commission, board,office,orotheragencyintheexecutive,judicial,orlegislative branch of state government that existsunder the constitutionor a statute of this state and that has authoritythat is not limited to a geographicalportionofthestate.
(6) Tenantagency--Astateagencyorinstitutionofhigher educationthatoccupiesabuildingmanagedbyanotherpartyandisnot responsibleforbuildingrenovationprojects.Atenantagencymayor maynotberesponsiblefordirectlypayingutilitybills.
[(12) Usingagency--Aninstrumentalityofthestatethatoc- cupiesand usesastate-ownedbuildingorfacilitythatanotherstate agencymanages.]
(7) [(13)]Utility--Electricity,gas,thermal,orotherenergy resource,water,andwastewater.
(8) Utilityconsumptiondata--Themeasuredamountofthe agency'sorinstitution'swater,electricity,gasoline,ornaturalgasus- age.
[(14) UtilityAssessmentReport--Adetailedassessmentof utilityandutilityrelatedoperationalefficiencythatispreparedby,or underthesupervisionof,apersonwhoisregisteredasaprofessional engineerundertheTexasEngineeringPracticeAct,andwhichiden- tifieseachofthecosteffectiveutilityand utilityrelatedoperational efficiencymeasuresorpracticesthatapplytothebuildingsorfacilities ofastateagencyorinstitutionofhighereducationasrequiredbythis chapter.]
§19.14. EnergyandWater[Utility]ManagementPlan[Planning]. (a) Requirements [Plan requirement]. The head of a state agencyoraninstitutionofhighereducation[asoutlinedin§19.12of thistitle(relatingtoApplication)]shallprepareanEnergyandWater Management[ensurepreparationofaResourceEfficiency]Planand submit the plan to SECO [the State EnergyConservation Office a certificationdocumentthattheplanhasbeencompleted].
(b) Guidelines.TheEnergyandWaterManagementPlanshall bepreparedin accordancewiththe guidelineslocatedonthe SECO website,whicharehereinadoptedbyreference.
(c) [(b)]Submission[date]. TheEnergyandWaterManage- ment[ResourceEfficiency]Plan[completioncertificationdocument] shall beupdatedand submittedby October 31 ofeach[even num- bered] year to [email protected] [beginning October 31,2002].
[(c) Contentsofplan. TheResourceEfficiencyPlanshallin- clude,ataminimum,thefollowing:]
[(1) asummaryof theoverall strategyand goalsforad- dressingutilityuseatstate-ownedbuildingsorfacilities;]
[(2) aUtilityAssessmentReport(UAR)oraPreliminary EnergyAudit(PEA)forarepresentativenumberofthestate-owned buildingsorfacilitiesthatthestateagencyorinstitutionofhighered- ucationoccupies,andaprojectedschedulethatoutlinestheplansfor completionofaUARorPEAforalltheremainingstate-ownedbuild- ingsorfacilitiesthattheagencyorinstitutionoccupies. TheUARor PEAshoulddetailrecommendationsforcosteffectiveresourceeffi-

ciencymeasuresthatcouldbeimplementedtoreduceutilityconsump-tionand/orutilitycosts;]
[(3) an ImplementationSchedule thatdescribes how the agencyorinstitutionplanstoachievetheagencyestablishedgoalsand implementtherecommendedcosteffectiveresourceefficiencymea- suresthatareidentifiedintheUARorPEA,andastrategyformoni- toringthestatusofimplementationoftheResourceEfficiencyPlan;]
[(4) aFinanceStrategythatdescribeshowtheagencyor institutionplanstoobtainfundingfortherecommendedcosteffective efficiencymeasures;]
[(5) aUtilityAwarenessPlanthroughwhichtheagencyor institutionwilleducateitspersonnelonutilityconservationmethods andpractices;]
[(6) an Asset Management Inventory that describes the agency'sorinstitution'sbuildingsorfacilities,inaformatthatSECO prescribes;]
[(7) atwo-yearhistoryofutilityuseandexpendituresfor thebuildingsandfacilitiesthatareidentifiedintheAssetManagement Inventory,inaformatthatSECOprescribes,including,withoutlimita- tion,theratesforutilitiesthatarechargedto,andtheamountofutilities thatareusedby,theagencyorinstitution.]
[(8) a Savings Monitoring and Evaluation Plan that de- scribes the plans for monitoring and evaluating utility efficiency savingsasaresultofimplementationoftherecommendationsinthe UAR;]
[(9) a Project Implementation Update that outlines the progressoverthe previoustwo yearsin implementation ofthe rec- ommendationsthatarecontainedinthepreviousResourceEfficiency Plan,includingasummaryoftheresultsoftheprojectsintermsof utilityefficiencyandcostsavings;]
[(10) thenameandaddressofthedesignatedofficialatthe agencyorinstitutionwhoisresponsibleforimplementationoftherec- ommendationsintheResourceEfficiencyPlan,andthenameandad- dressofanagencyorinstitutioncontactpersonfortheResourceEffi- ciencyPlan;]
[(11) any ResourceEfficiency Plans that using agencies haveprepared.]
(d) Implementation. Astateagency orinstitutionof higher educationshallimplementthecosteffectiveutilityconservationmea- suresinaccordancewiththetimelinesandrecommendationsthatare containedintheagency'sorinstitution'sEnergyandWaterManage- mentPlan.Totheextentfeasible,utilityandutility-relatedoperational improvementsthataremadetoeachbuildingorfacilityshallbeimple- mentedthroughcomprehensiveprojects.[Theplanforausingagency orforanagencythatleasesspaceshallincludeonlythoseprovisions ofsubsection(c)ofthissectionthatapplytotheoccupyingagency's situation.]
[(e) AfterthedeadlineforcompletingorupdatingaResource EfficiencyPlanhaspassed,SECOmayrequireastateagencyorin- stitutionofhighereducationtosubmititsResourceEfficiencyPlanto SECOforreview.TheResourceEfficiencyPlanshallbesubmittedto SECOwithin30daysofreceivingarequestfromSECOtosubmitthe plan.]
§19.16. LongRangeUtilityServicesPlan.
(a) Requirement. Astateagencyorinstitutionofhighered- ucationthatpurchasesutilitiesshallprepare[andsubmittotheState EnergyConservationOffice(SECO)]alongrangeplanforthedeliv- eryofreliable,cost-effectiveutilityservicesfortheagencyorinstitu-
tion. [Thisplanmaybesubmittedinconjunctionwith,oraspartof, theResourceEfficiencyPlan. Theagencyorinstitutionshallupdate theLongRangeUtilityServicesPlanatleasteveryfiveyearstosup- portfive-yearconstructionandmajorrenovationplanning.]
(b) Guidelines. SECO shall post guidelines for the Long RangeUtilityServicesPlanonitswebsite.
(c) Frequency.TheagencyorinstitutionshallupdatetheLong RangeUtilityServicesPlanatleasteveryfiveyearstosupportfive-year constructionandmajorrenovationplanning.
(d) Submission. TheplanshallbesubmittedtoSECOupon request.
§19.17. UtilityConsumptionDataReporting[BillReview]. (a) Requirement. Eachstateagencyorinstitutionof higher educationshallreportutilityconsumptiondatatoSECO[reviewand auditutilitybillingsandcontractstodetectbillingerrors].
(b) Guidelines. SECOshall postguidelines forutilitycon- sumptiondataonitswebsite.
(c) Frequency.Utilityconsumptiondatashallbesubmittedno laterthanOctober31ofeachyear,beginningOctober31,2015.
The agencycertifies that legal counsel hasreviewedthepro- posalandfoundittobewithinthestateagency'slegalauthority toadopt.

The Comptroller of Public Accounts proposes the repeal of §19.15,concerningimplementationofresource efficiencyplan recommendations; §19.18, concerning semiannual reporting; and§19.19,concerningextensionoftime.
Therepealof§19.15removestherequirementsrelatingtothe ResourceEfficiencyPlan,whichisnolongerrequiredbyGov- ernmentCode,§447.009.Instead,thestatutereplacedtheRe- sourceEfficiencyPlanwiththeEnergyandWaterManagement Plan,whichisaddressedintheproposedamendmentto§19.14 ofthischapter.
Therepealof§19.18removestherequirementsrelatingtosemi- annualreporting,whicharenolongerrequiredbytheStateEn- ergyConservationOffice(SECO).
Therepealof§19.19removestherequirementsrelatingtoexten- sionoftimetosubmitanyrequiredplanorreport,andclarifies thatnoextensionswillbepermittedsinceSECOhasalimited amountoftimeafterthedeadlinetosubmitthisinformationto thelegislature.
