WHEREAS, the Council of the City of Newport News, Virginia, wishes to honor and recognize Mayor Joe S. Frank upon the conclusion of his twenty-two years as a member of the Newport News City Council; and

WHEREAS, Joe S. Frank, a lifelong resident of the City of Newport News, Virginia, and a graduate of the Newport News Public School system, received his Bachelors of Arts degree, with Honors, from the University of Virginia. He went on to study law at the University of Virginia Law School, where he graduated with an LL.B. degree. Following graduation, he returned to Newport News to practice law. He was admitted to the Virginia State Bar in 1967, and has practiced in Newport News continuously since then. From 1968 through 1974, he served as a member of the 4 Battalion 111 Artillery of the Virginia Army National Guard. He married Janeth th Susan Glasser, and they have been blessed with three children and numerous grandchildren; and WHEREAS, Joe S. Frank’s dynamic leadership and commitment to the community developed at an early age. At the age of 11, he joined the Boy Scouts, moving through the ranks quite rapidly and ultimately becoming an Eagle Scout. He has served in numerous leadership positions for the Boy Scouts, including Senior Patrol Leader and Assistant Scout Master. In high school, he served on the Student Council Association, and was elected President of the Speech Arts Club, National Honor Society, and Key Club. His devotion to community service has never wavered, and Joe Frank has served in many leadership positions within the community, including serving as Chairman of the Hampton Roads Military and Civilian Family Violence Prevention Council, Chairman of the Newport News/Williamsburg International Airport Task Force, Chairman of the Physicians Task Force, Chairman of the Newport News Democratic Committee, Chairman of the Newport News Youth Risk Prevention Committee, and President of Homebase of the Virginia Peninsula; and

WHEREAS, Joe S. Frank began a career of public service in 1988 when he was elected to the Newport News City Council. From 1988 to 1990, he served as Vice Mayor, a position he would again hold in 1996. In 1996, he became the first directly elected Mayor in the City’s history, and was subsequently reelected in 1998, 2002, and 2006; and

WHEREAS, the commitment of Joe S. Frank to the economic development and the betterment of Newport News and the region is well documented. He has served on the Board of Directors of numerous organizations, including the Hampton Roads Partnership, the Hampton Roads Economic Development Alliance, the Hampton Roads Planning District Commission, the Hampton Roads Transportation Planning Organization, and the Hampton Roads Mayors and Chairs Caucus. He has also served as a member of the Peninsula Alliance for Economic Development,

the Hampton Roads Jaycees, and the Governor’s Urban Policy Task Force. He served as Chairman of the Oyster Point Development Corporation during its formative years. During his tenure, a master plan was instituted, initial financing was arranged, and the beginning of development in Oyster Point was achieved; and

WHEREAS, Joe S. Frank has been honored by numerous organizations, and these honors include an Honorary Doctor of Laws Degree from Christopher Newport University, the President’s Leadership Award from Thomas Nelson Community College, the Boy Scouts of America Distinguished Eagle Scout Award, Virginia Peninsula Chamber of Commerce Distinguished Citizen Award - Citizen of the Year, National Conference of Christians and Jews Humanitarian Award, Colonial Virginia Council Boy Scouts of America Good Scout Award, and the Honorable Order of St. Christopher, America Hero Award and Honorary Member, U.S. Army Transportation Corps Regiment; and

WHEREAS, Joe S. Frank has made many valuable contributions to the City, the Virginia Peninsula, the entire Hampton Roads Region, and the Commonwealth of Virginia.

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Newport News, Virginia:

1. That it hereby recognizes Joe S. Frank on the conclusion of his fourteen years as mayor and twenty two years as a member of the Newport News City Council.

2. That it expresses its heartfelt appreciation for his many contributions to the City, the Virginia Peninsula, the Hampton Roads Region and the Commonwealth of Virginia.

3. That a copy of this resolution be spread upon the records of this body and that a copy be delivered to Joe S. Frank as a token of respect and warm appreciation of this Council and the citizens of Newport News.

4. Resolution Authorizing the City Manager to Execute the Standard Project

Administration Agreement between the City and VDOT for the Huntington Avenue Bridge Replacement Project

ACTION: A REQUEST TO APPROVE A RESOLUTION

AUTHORIZING THE CITY MANAGER TO EXECUTE THE STANDARD PROJECT ADMINISTRATION AGREEMENT FOR THE HUNTINGTON AVENUE BRIDGE REPLACEMENT PROJECT.

BACKGROUND: l The project proposes to replace the Huntington Avenue Bridge over Newport News Shipbuilding & Dry Dock at 40th Street.

FISCAL IMPACT: l The City will be responsible for front-funding and administering the project, which is estimated at $1,200,000.

l The City has been successful in obtaining approval for $600,000 in the FY 10 State Revenue Sharing Program Fund for this project.

l The City Manager recommends approval. l N/A

5. Ordinance Amending and Reordaining City Code, Chapter 26, Article VIII., Section 26-215, Distribution of Handbills, etc., Solicitation of Contributions, and Sale of Merchandise or Services on Highways, Public Roadways, and Medians Prohibited

ACTION: A REQUEST TO ADOPT AN ORDINANCE

AMENDING AND REORDAINING CITY CODE, CHAPTER 26, MOTOR VEHICLES AND TRAFFIC, ARTICLE VIII., PEDESTRIANS, BY AMENDING SECTION 26-215, WHICH WILL PROHIBIT THE DISTRIBUTION OF HANDBILLS, ETC.,

SOLICITATION OF CONTRIBUTIONS, AND SALE OF MERCHANDISE OR SERVICES ON HIGHWAYS, PUBLIC ROADWAYS, AND MEDIANS.

BACKGROUND: l One of the City's Legislative priorities for the 2010 General Assembly resulted in an amendment to Section 46.2-931 of the Code of Virginia which permits localities to prohibit the distribution of handbills, etc., on highways, public roadways, and medians.

l Section 26-215 of the City Code was adopted to prohibit these activities, with an objective of improving traffic safety and to reduce the risk of serious inujury to the public.

l Section 26-215 of the City Code needs to be amended to clarify that the activities at issue are prohibited within the City's highways, public roadways and medians.

l The City Manager recommends approval. FISCAL IMPACT: l N/A
