(a) FUNDING.—Section 2104(a) of the Social Secu-

21

rity Act (42 U.S.C. 1397dd(a)) is amended—

22

(1) in paragraph (17), by striking ‘‘and’’ at the

23

end;

(2) in paragraph (18)(B), by striking the period

1

at the end and inserting a semicolon; and

2

(3) by adding at the end the following new

3

paragraphs:

4

‘‘(19) for fiscal year 2016, $19,300,000,000;

5

and

6

‘‘(20) for fiscal year 2017, for purposes of mak-

7

ing 2 semi-annual allotments—

8

‘‘(A) $2,850,000,000 for the period begin-

9

ning on October 1, 2016, and ending on March

10

31, 2017; and

11

‘‘(B) $2,850,000,000 for the period begin-

12

ning on April 1, 2017, and ending on Sep-

13

tember 30, 2017.’’.

(b) ALLOTMENTS.—

15

(1) IN GENERAL.—Section 2104(m) of the So-

16

cial Security Act (42 U.S.C. 1397dd(m)) is amend-

17

ed—

18

(A) in the subsection heading, by striking

19

‘‘THROUGH 2015’’and inserting ‘‘AND THERE-

20

AFTER’’;

21

(B) in paragraph (2)—

22

(i) in the paragraph heading, by strik-

23

ing ‘‘2014’’ and inserting ‘‘2016’’; and

(ii) by striking subparagraph (B) and

inserting the following new subparagraph:

‘‘(B) FISCAL YEAR 2013 AND EACH SUC-

3

CEEDING FISCAL YEAR.—Subject to paragraphs

4

(5) and (7), from the amount made available

5

under paragraphs (16) through (19) of sub-

6

section (a) for fiscal year 2013 and each suc-

7

ceeding fiscal year, respectively, the Secretary

8

shall compute a State allotment for each State

9

(including the District of Columbia and each

10

commonwealth and territory) for each such fis-

11

cal year as follows:

12

‘‘(i) REBASING IN FISCAL YEAR 2013

13

AND EACH SUCCEEDING ODD-NUMBERED

14

FISCAL YEAR.—For fiscal year 2013 and

15

each succeeding odd-numbered fiscal year

16

(other than fiscal years 2015 and 2017),

17

the allotment of the State is equal to the

18

Federal payments to the State that are at-

19

tributable to (and countable toward) the

20

total amount of allotments available under

21

this section to the State in the preceding

22

fiscal year (including payments made to

23

the State under subsection (n) for such

24

preceding fiscal year as well as amounts

redistributed to the State in such pre-

ceding fiscal year), multiplied by the allot-

2

ment increase factor under paragraph (6)

3

for such odd-numbered fiscal year.

4

‘‘(ii) GROWTH FACTOR UPDATE FOR

5

FISCAL YEAR 2014 AND EACH SUCCEEDING

6

EVEN-NUMBERED FISCAL YEAR.—Except

7

as provided in clauses (iii) and (iv), for fis-

8

cal year 2014 and each succeeding even-

9

numbered fiscal year, the allotment of the

10

State is equal to the sum of—

11

‘‘(I) the amount of the State al-

12

lotment under clause (i) for the pre-

13

ceding fiscal year; and

14

‘‘(II) the amount of any pay-

15

ments made to the State under sub-

16

section (n) for such preceding fiscal

17

year,

18

multiplied by the allotment increase factor

19

under paragraph (6) for such even-num-

20

bered fiscal year.

21

‘‘(iii) SPECIAL RULE FOR 2016.—For

22

fiscal year 2016, the allotment of the State

23

is equal to the Federal payments to the

24

State that are attributable to (and count-

able toward) the total amount of allot-

ments available under this section to the

2

State in the preceding fiscal year (includ-

3

ing payments made to the State under

4

subsection (n) for such preceding fiscal

5

year as well as amounts redistributed to

6

the State in such preceding fiscal year),

7

but determined as if the last two sentences

8

of section 2105(b) were in effect in such

9

preceding fiscal year and then multiplying

10

the result by the allotment increase factor

11

under paragraph (6) for fiscal year 2016.

12

‘‘(iv) REDUCTION IN 2018.—For fiscal

13

year 2018, with respect to the allotment of

14

the State for fiscal year 2017, any

15

amounts of such allotment that remain

16

available for expenditure by the State in

17

fiscal year 2018 shall be reduced by one-

18

third.’’;

19

(C) in paragraph (4), by inserting ‘‘or

20

2017’’ after ‘‘2015’’;

21

(D) in paragraph (6)—

22

(i) in subparagraph (A), by striking

23

‘‘2015’’ and inserting ‘‘2017’’; and

(ii) in the second sentence, by striking

‘‘or fiscal year 2014’’ and inserting ‘‘fiscal

2

year 2014, or fiscal year 2016’’;

3

(E) in paragraph (8)—

4

(i) in the paragraph heading, by strik-

5

ing ‘‘FISCAL YEAR 2015’’ and inserting

6

‘‘FISCAL YEARS 2015 AND 2017’’; and

7

(ii) by inserting ‘‘or fiscal year 2017’’

after ‘‘2015’’;

(F) by redesignating paragraphs (4)

through (8) as paragraphs (5) through (9), re-

(G) by inserting after paragraph (3) the

following new paragraph:

‘‘(4) FOR FISCAL YEAR 2017.—

‘‘(A) FIRST HALF.—Subject to paragraphs

16

(5) and (7), from the amount made available

17

under subparagraph (A) of paragraph (20) of

18

subsection (a) for the semi-annual period de-

19

scribed in such paragraph, increased by the

20

amount of the appropriation for such period

21

under section 301(b)(2) of the Medicare Access

22

and CHIP Reauthorization Act of 2015, the

23

Secretary shall compute a State allotment for

24

each State (including the District of Columbia

and each commonwealth and territory) for such

1

semi-annual period in an amount equal to the

2

first half ratio (described in subparagraph (D))

3

of the amount described in subparagraph (C).

4

‘‘(B) SECOND HALF.—Subject to para-

5

graphs (5) and (7), from the amount made

6

available under subparagraph (B) of paragraph

7

(20) of subsection (a) for the semi-annual pe-

8

riod described in such paragraph, the Secretary

9

shall compute a State allotment for each State

10

(including the District of Columbia and each

11

commonwealth and territory) for such semi-an-

12

nual period in an amount equal to the amount

13

made available under such subparagraph, multi-

14

plied by the ratio of—

15

‘‘(i) the amount of the allotment to

16

such State under subparagraph (A); to

17

‘‘(ii) the total of the amount of all of

18

the allotments made available under such

19

subparagraph.

20

‘‘(C) FULL YEAR AMOUNT BASED ON

21

REBASED AMOUNT.—The amount described in

22

this subparagraph for a State is equal to the

23

Federal payments to the State that are attrib-

24

utable to (and countable towards) the total

amount of allotments available under this sec-

1

tion to the State in fiscal year 2016 (including

2

payments made to the State under subsection

3

(n) for fiscal year 2016 as well as amounts re-

4

distributed to the State in fiscal year 2016),

5

multiplied by the allotment increase factor

6

under paragraph (6) for fiscal year 2017.

7

‘‘(D) FIRST HALF RATIO.—The first half

8

ratio described in this subparagraph is the ratio

9

of—

10

‘‘(i) the sum of—

11

‘‘(I) the amount made available

12

under subsection (a)(20)(A); and

13

‘‘(II) the amount of the appro-

14

priation for such period under section

15

301(b)(2) of the Medicare Access and

16

CHIP Reauthorization Act of 2015;

17

to

18

‘‘(ii) the sum of the—

19

‘‘(I) amount described in clause

20

(i); and

21

‘‘(II) the amount made available

22

under subsection (a)(20)(B).’’.

23

(2) CONFORMING AMENDMENTS.——

(A) Section 2104(c)(1) of the Social Secu-

rity Act (42 U.S.C. 1397dd(c)(1)) is amended

2

by striking ‘‘(m)(4)’’ and inserting ‘‘(m)(5)’’.

(B) Section 2104(m) of such Act (42

4

U.S.C. 1397dd(m)), as amended by paragraph

5

(1), is further amended—

6

(i) by striking ‘‘the allotment increase

7

factor determined under paragraph (5)’’

8

each place it appears in paragraphs (1)

9

(2)(A), and (3) and inserting ‘‘the allot-

10

ment increase factor determined under

11

paragraph (6)’’;

12

(ii) in paragraph (1)—

13

(I) by striking ‘‘paragraph (4)’’
