1 Precisiones conceptuales
Article 140(number of deliberations)
The department can decide to organize, with a view to the manageability of the meeting of the examination board, more than one meeting of the examination board per examination period.
Article 141(attendance)
The members of the examination board participate in the deliberations and sign the roll of attendance. The examination board makes valid decisions whenever at least half the members (or if such is the case, their representatives) is present. A member who is legitimately
prevented from attending shall advise the chairperson of the examination board as soon as possible.
If certain students must make themselves available to the examination board during the deliberations, the chairperson of the examination board will inform them beforehand.
Article 142(confidentiality)
The members of the examination board and all persons present at the session are bound by the obligation of secrecy of the deliberations and the votes.
Article 143(voting members)
Members of the examination board do not participate in the deliberations over decisions as regards affinity and consanguinity to the fourth degree.
Members of the examination board about whom it is implied that a grade awarded by them to an individual student or a group of students can be shown to be unreasonable do not
participate in the deliberations of this student or group of students.
The examination ombudsperson and the student dean participate in the deliberations with an advisory vote.
Article 144(consultation of non-members by the (qualified) examination board)
Every examiner who is not a member of the examination board can have his request heard by the qualified examination board and the examination board. The same applies for each student over whom the examination board has made a decision.
If an irregularity is established, the qualified examination board must, before the examination board can make a decision, hear the member of the teaching staff who established the
irregularity. The qualified examination board must also hear the student concerned.
If the qualified examination board decides that the grade for the individual student or group of students given by the examiner is clearly unreasonable, it must, before the examination board can make a decision, hear the examiner.
The examination board itself can make a decision to hear an examiner who is not a member of the examination board about its intended decision.
Article 145(The examination board as a board and the rules on decisions and voting)
The examination board acts as a board. The examination board renders decision on a student by simple majority (i.e. more than half of the members present). This simple majority is presumed as regards any decision proposed by the chairperson.
At the suggestion of the chairperson or, if requested by a board member, the examination ombudsperson or the student dean, votes on a decision, both during and at the end of the program, will be taken by secret ballot. Neither invalid votes nor abstentions will be included in counting the votes. If the votes are tied, the most advantageous outcome for the student or student group shall form the valid proposal of the board.
Article 146(criteria for successful completion of a course unit)
The student successfully completes a course unit if he is awarded at least 10 out of 20 or the assessment of ’passed’.
In both cases the student is granted a credit certificate, unless he has not paid his fees on time, an irregularity has been established for which the student will be penalized or the student exercises the option to improve his result as stipulated in Article 159 (retaking examinations for educational activities/course units) §5.
If a mark for an educational activity is less than 5 on 20, it is possible to deviate from the assessment provided under Article 134,Article 134 second paragraphArticle 134 and a failing grade be given for the course unit. The course unit coordinator undertakes this after consulting with all examiners involved in the educational activities included in the course unit. This deviation is reported to the chairperson of the examination board at the latest by the day before the deliberations and must be approved by the examination board. The student concerned is informed of this decision.
To determine the percentage achieved over an entire program, the grades obtained for each course unit are weighted according to the number of credits that are connected to it.
The course units that are evaluated according to the pass/fail model are not included in calculating the percentage.
Article 148(rules on rounding off)
For the application of Article 149Article 149, Article 150, Article 151 and Article 160Article 150:
• the student's combined results will be rounded down to the nearest percentage for decimals from 0.1 to 0.4 and rounded up to the nearest percentage for decimals from 0.5 to 0.9;
• the number of credits that corresponds with the application of the 10% rule and the 50% study efficiency rule as defined under Article 149 will be rounded down to the nearest credit for decimals 0.1 to 0.4 and rounded up to the nearest credit for decimals 0.5 to 0.9.
Article 149(criteria for successful completion of a program)
A student successfully completes a program if he either:
a) successfully completes (at least 10/20 or passing grade) or is exempt from all course units of the program under the diploma contract or the examination contract with the goal of obtaining a diploma;
b) or satisfies both of the following conditions:
• he obtains at least 50% as a weighted percentage for the program as a whole;
• he obtains no intolerable failing grades and a maximum of 10% tolerable failing grades.
Tolerable failing grades are assessments of 8 or 9 on 20 or an assessment in the form of a fail, unless the program committee considers a fail as intolerable. All other failing grades are intolerable. The percentage of the tolerance credit is calculated based on all the actual credits in the program taken by the student not including the credits that the student takes in addition to the number of credits for the model track for the program. Exemptions received are not included in the calculation. For the structure of the tolerance credit, see also Article 161Article 161.
By way of exception to the provisions mentioned under b) above, the department, following advice from the program committee, can decide that:
• only a limited number of tolerable failing grades, expressed in credits, may appear in a certain group of course units; and/or
In special individual circumstances not related to study and force majeure (cf. Article
139Article 139, par 7), if a student has not satisfied the postulated conditions as set out under paragraph one, the examination board can still declare the student as having successfully passed if they deem that the student has achieved the postulated learning results for the entire program.
Article 150(criteria for obtaining a diploma or certificate and a degree of distinction)
Any student who has successfully completed a program in accordance with the criteria set out in Article 149Article 151 is awarded the program diploma or certificate.
Any student who is awarded a bachelor or master’s degree or a postgraduate certificate will be awarded the following degree of distinction:
• satisfactory, if his weighted examination grade is at least 68% ;
• cum laude, on condition that his weighted examination grade is at least 68%;
• magna cum laude, on condition that his weighted examination grade is at least 77%;
• summa cum laude, on condition that his weighted examination grade is at least 85%;
• summa cum laude and the congratulations of the examination board, on condition that his weighted examination grade is at least 90%.
The calculation is based on the sum total of the program.
An individual student who does not satisfy the criteria for the award of a certain degree of distinction can still be awarded this degree of distinction if the examination board:
• establishes force majeure, or;
• so decides based on well-founded reasons. These reasons are included in the deliberation report.
No degree of distinction will be awarded to students whose actual study program is less than 20 credits. Nor will a degree of distinction be awarded for a transition or preparatory program.
Article 151(deliberation report)
The deliberation report is drafted and signed by the chairperson and the secretary of the examination board. It includes the roll of attendance and mentions the decision or the determination as specified under Article 146Article 146, Article 149Article 149 and Article 150Article 150 and any observation of the procedural rules of Article 139Article 139 up to and including Article 145Article 145. The report includes the examination grades or indicates the examination grades that are attached to the report or saved as a secure electronic file. The deliberation report also includes, as the case may be, the reasoned decisions based on Article 139Article 139, Article 144Article 144, Article 145Article 145, Article 149Article 149, Article 150Article 150, Article 154Article 154, Article 159Article 159, Article 160Article 160, Article 164Article 164, Article 165Article 165 and Article 166Article 166.
The chairperson or the secretary of the examination board allows students whose interests so indicate and as far as it concerns them, access to the deliberation report until at the latest one month following the start of the following academic year.
