4.2.2. Resultados de la identificaci´ on de los Elementos de Inseguridad

1. Staff Qualifications and Competencies: Individuals working as DSP and supervisors for Family Living Provider Agencies meet the following requirements:

a. Be eighteen (18) years or older;

b. Have a high school diploma or GED;

c. Have the ability to understand and implement the individual’s ISP and related healthcare and behavioral plans as applicable;

d. Have the ability to instruct and assist the individual to meet his or her physical (e.g., health, grooming, toileting, eating, self-administration of medication) and personal management needs, by teaching skills, providing supports, and building on individual strengths and capabilities;

e. Have the ability to instruct and assist the individual with household management (e.g., meal prep, laundry, cleaning, decorating) and with needs outside the home such as using public transportation or accessing other community services;

f. Have the ability to instruct and assist the individual with identifying, securing, maintaining and using needed adaptive equipment, augmentative communication devices and assistive technology and implementing therapy strategies in accordance with WDSI developed by therapist(s) serving the individual. The ability to support the individual in the development of friendships and other relationships;

g. Have the ability to identify crisis situations, defuse the situation, implement immediate intervention crisis response strategies consistent with the BCIP, PBSP or other relevant intervention strategies or actions identified in the ISP;

h. Have the ability to instruct and assist with the implementation of therapy, healthcare, positive behavioral support, behavior crisis intervention, medical emergency response and comprehensive aspiration risk management plans, if applicable;

i. Have the ability to maintain accurate records;

j. Have the ability to maintain standards of confidentiality and ethical practice;

k. Have the ability to effectively employ communication skills to build rapport and channels of communication by recognizing and adapting to the range of individual communication styles;

l. Have the ability to instruct and assist and support the individual to develop strategies, make informed choices;

m. Have the ability to identify the need for community supports and work with the individual’s informal support system and other IDT Members to initiate meaningful community connections; and

n. Maintain current First Aid and CPR certification.

2. Qualification for Agency Supervisors: Personnel who are directly responsible for the supervision of Family Living DSP’s are required to meet the following requirements:

a. Be twenty-one years of age or older;

b. Have a high school diploma or G.E.D;

c. Have a minimum of one-year experience working with individuals with developmental disabilities or related field or a degree in a related field may substitute for experience;

d. Complete training and demonstrate the competencies specified in the DDSD Policy T-003: Training Requirements for Direct Service Agency Staff; and

3. Training:

a. All Family Living Provider agencies must ensure staff training in accordance with the Training Requirements for Direct Service Agency Staff policy. DSP’s or subcontractors delivering substitute care under Family Living must at a minimum comply with the section of the training policy that relates to Respite, Substitute Care, and personal support staff [Policy T-003: for Training Requirements for Direct Service Agency Staff; Sec. II-J, Items 1-4]. Pursuant to the Centers for Medicare and Medicaid Services (CMS) requirements, the services that a provider renders may only be claimed for federal match if the provider has completed all necessary training required by the state. All Family Living Provider agencies must report required personnel training status to the DDSD Statewide Training Database as specified in DDSD Policy T-001: Reporting and Documentation for DDSD Training Requirements.

b. Individual specific training must be arranged and conducted, including training on the Individual Service Plan outcomes, actions steps and strategies and associated support plans (e.g. health care plans, MERP, PBSP and BCIP etc), information about the individual’s preferences with regard to privacy, communication style, and routines. Individual specific training for therapy related WDSI, Healthcare Plans, MERPs, CARMP, PBSP, and BCIP must occur at least annually and more often if plans change or if monitoring finds incorrect implementation. Family Living providers must notify the relevant support plan author whenever a new DSP is assigned to work with an individual, and therefore needs to receive training, or when an existing DSP requires a refresher. The individual should be present for and involved in individual specific training whenever possible.

c. Because much of the training by therapists and is most effective in the context of natural environments and functional daily routines, DSP must be available to participate in therapy/BSC appointments with the individual on a regular basis as requested.

d. Nurse training requirements are as follows:

i. Current CPR certification.

ii. Completion of the DDSD Nurse Orientation and Healthcare Planning modules within the first ninety (90) calendar days of hire or assignment to this service.

iii. Within the first one-hundred-eighty (180) calendar days of hire or assignment to the service, complete a two (2) day course on Assisting with Medication Delivery, as an observer, in order to ensure awareness of the expectations of direct support personnel assisting individuals with medication.

iv. Completion of Person Centered Planning and Effective Individual Specific Training courses within twelve months of hire.

v. ARM Training.

4. Criminal Background Screening: Family Living Provider agencies will assure required staff has a current and clear criminal background screening.

5. Staffing Restrictions:

a. Any individual who operates or is an employee of a boarding home, residential care home, nursing home, group home or other similar facility in which the individual resides must not serve as guardian for that individual, except when related by affinity or consanguinity [§ 45-5-31(1) A NMSA (1978)]. Affinity which stems solely from the caregiver relationship is not sufficient to satisfy this requirement.

b. The spouse of the individual may not provide Family Living Services to that individual.
