The Contractor's attention is drawn to the fact that NI intends to establish a TAP. The aforesaid does not derogate from the Contractor obligation to comply with the instructions of the NI and the PM in accordance the provision of the Contract.

The TAP will be responsible for delivering technical assurance that the 3 railway lines are constructed in accordance with the pre-approved list of technical standards meeting ISR’s agreed requirements. The TAP instructions are not part of the Contractor obligation in accordance to the Contract provisions.

The TAP will operate between NI and ISR, be answerable to both companies and the members of TAP will be technically approved by ISR. The following diagram illustrates this arrangement:

The TAP will be headed up by an agreed accountable person, with a deputy accountable person, who manages TAP, advising and acting as the technical interface with ISR. A consistent approach will be followed by the TAP across the technical disciplines so that all areas are reviewed to the same level of scrutiny.

The independence of the TAP is structural and agreed by all parties. The purpose, role and processes of TAP will be presented to all suppliers, clients, internal and external stakeholders. The TAP management plan will quantify the activity and establish the terms of reference for the function. The TAP role sits well alongside QA role – this arrangement is a well-established model for railway infrastructure Projects where there are many diverse and complex technical disciplines needed to ensure the Project achieves the agreed technical results.

The workflow is essentially very simple - the NI Project produces specifications, drawings and construction Contractor outputs (products) which are reviewed by TAP on ISR’s behalf against the previously agreed standards. The volume of work and efficiency of reviews will be overseen by TAP management and reported to ISR and NI.

A construction verification of the substructure projects(s) is planned to be undertaken on behalf of TAP to independently identify the actual construction and then carry out a gap analysis between the ABP substructure and the base-line start for the design assumptions of the superstructure Project. Then a design standards manual need to be setup and approved for the superstructure Project to ensure the technical standards being used are correct and current. If required, a full design compliance review could be carried out by TAP prior to the design being tendered for construction to enable any gaps identified to be plugged and ensure the design is not just acceptable but technically adequate.

Once the works enter the construction phase TAP will undertake review of the Contractor’s construction technical quality control procedures, carry out inspections of the Site works and review the ABP records. A technical concession approval committee will need to be established for the technical approval of deviations to ensure the actual performance is not compromised. The responsibility for preparation of the concession will be with the construction Contractor/designer. The development of a suitable concessions procedure will be required. The QA team will review all processes, procedures and their effectiveness in practice to deliver the required result.

28 Bill Of Quantities (BOQ) and prices

Each description given for each of the sections in the BOQ does not necessarily describe the work in full. The full description includes all that stated in the plans, the Contract Volumes and in the implementation of the NI's and the PM's instructions. The BOQ complements that stated in the specifications and plans but does not, in any way, detract from that stated in them. Not all of the works detailed in the BOQ will necessarily referred to this volume and this volume should be as supplementary to the collection of general technical specifications regarding paving and bridge works (general specifications for paving and bridge works – updated edition) published by the NI, ISR specifications and the general specification for construction work (the inter office specification the blue book).

29 Hourly wage ("reggie") 29.1 General

This chapter relates to special works and jobs that cannot be anticipated in advance and cannot be measured in terms of the Contract sections and for which the PM has decided not to set for them a price for additional work (exceptions) but rather to perform the work based on an hourly rate for employee, tools etc.

The execution of these works is dependent on prior instructions, in writing, from the PM and the Contractor may not execute them at his own decision. The work method will be determined by the PM however, the responsibility for the management is that of the Contractor within the framework of responsibility of this Contract.

Payment will be according to the price per work hour (whether for people or equipment as needed) according to the type as detailed in the NI's price list as published periodically. In the event that no price list has been published by NI, the price will be in accordance with the

"Dekel computers engineering services (1986) Ltd." price list less 10% (ten percent) discount for each separate item.

The price also includes all additional materials such as fuel, oil, depreciation, work and all needed for the successful execution of the work by the relevant employee or tool, unless the relevant price list details separate prices for those elements.

If, in the PM's opinion, an employee or tool delegated for these works are sufficiently efficient for the work, he is entitled to disqualify them from executing the work and the Contractor will be required to replace them, at his expense and all expenses relating to this replacement will also be at the Contractor's expense.
