n/a √ Significant Trees Technical Report (Section 32, Appendix 6, page 36) states that the leading cause of tree death during landscape and other construction activities is damage to roots. Damage is usually the result of digging, grading or compacting of soils within the “critical root zone” of a tree. “Critical root zone” is defined through the section 32 analysis as the area in which the loss, disturbance, or damage to any roots will adversely affect the tree’s long-term health and structural integrity. Accordingly an amendment to RD4 and RD5 is sought to ensure significant trees are not adversely affected by earthworks.This means including earthworks in the matters of discretion as opposed to excluding them.

Discretion – Trees √ Specific Purpose (Flat Land Recovery) Zoneapplies to the Canterbury Earthquake Recovery Authority (CERA) ‘Red Zone’ areas on the flat which were identified by the Crown where rebuilding may not occur in the short-to- medium term. The consideration of recovery activities and the significance of these in this area should be a component of assessment. Therefore the need for the matter of discretion. This includes land along the Avon River (Avon Loop through Burwood and Avondale to New Brighton), Brooklands and Southshore at New Brighton. In acknowledgement the role of recovery activities in this zone an additional specific matter of discretion is proposed.

Appendix 9.4.5.1.2 87. 10 - Designations - State- Integrated Schools Schedule - L125 Notice of requirement to designate Mairehau Catholic Primary School for "education purposes" L125
√ The post-quake redevelopment of this school was approved via resource consent in May 2014. The site layout and design was such that there was potential for noise nuisance to adjoining properties along one site boundary adjoining car parking, vehicle access areas and an adventure playground. An acoustic fence was agreed as being required to avoid noise standard non-compliance and is a condition of that consent.
A condition requiring the construction of an acoustic fence (as was required by the resource consent) is sought to address potential noise effects on neighbouring properties, if the development was to proceed under the designation rather than the existing consent.
Add a condition to L125 as follows:
"1. A solid construction acoustic fence shall be provided within six months of the sealing of the car parking areas along the school’s western
boundary. This fence shall extend along this western boundary
commencing at 15 m into the site from the road boundary, and extending 200 m into the site adjoining all car parking and vehicle access areas and beyond the rear car park and relocated playground.
This fence shall:
· Have a minimum height of 2m when measured above any neighbouring property’s ground level at the fence line;
· Have a surface mass of at least 8.0 kg/m2 (Materials meeting the surface mass specification include 20 mm thick timber
overlapped or on a board and batten configuration, or a range of proprietary building materials such as Hardiflex, Titan Board, concrete block or Hebel block);
· Be continuous and maintained without gaps. (Any gaps between the bottom of the fence on the ground can be avoided using solid material such as sleepers or ground treated boards);
· Be maintained in accordance with these parameters at all times."

√ The Minister has not sought any conditions be included on the designation, if confirmed. The proposed Former Dwelling heritage item (#27) and its heritage setting (#200) at Middleton Grange School is identified within the proposed designation site.

If the designation is confirmed the use of the site for education purposes will be permitted and district plan rules, including those relating to historic heritage, will not apply.
