RESOLUTION OF THE RECTOR, DATED 14 MARCH 2020, OF MEASURES DUE TO THE SITUATION ON HEALTH CRISIS CAUSED BY COVID-19

Background

Given the emergency due to covid-19, the Government of the Generalitat of

Catalonia has been taking various measures aimed at reducing activity and avoiding concentrations of people to prevent contagion.

In addition, in accordance with Law 31/1995, of 8 November, on the Prevention of Occupational Risks, the University of Girona must ensure the health and safety of the staff, adopting the necessary protection and health measures. This obligation should be extended to the students.

In accordance with the above, and in accordance with the provisions of Royal Decree 463/2020, of 14 March, declaring the state of alarm for the management of the health crisis caused by covid-19, and by virtue of the powers conceded by Articles 93 and 97 of the Statutes of the University of Girona (Agreement GOV/94/2011, 7 June approving the amendment of the Statutes of the University of Girona and the publication of its full text – DOGC No. 5897 of 9 June 2011) and Royal Decree 1065/2017 of 22 December on the appointment of the rector of the University of Girona (BOE No. 316., 29 December 2017),

RESOLUTION:

First. Maintain the activity of the University of Girona, although, as far as possible, it will be carried out, by the staff, through teleworking.

Cases where teleworking is not possible, and presence in the workplace is not

necessary, shall be considered as a justified absence, without loss of rights. The staff in this case will be at the disposal of the Management.

All face-to-face staff training activities are suspended.

Second. Suspend all face-to-face teaching activities corresponding to any type of training. Seminars, conferences, congresses, etc. are also suspended.

In order to guarantee the distance teaching, the digital resources and telematic tools available to the University of Girona will be used.

Teaching and research staff should strengthen attendance and mentoring to students through the above tools. In no case may meetings or face-to-face tutorials be

organized.

Third. Suspend all curricular and extracurricular practicals of students of the University of Girona. However, if such practicals are possible in a not-in-person manner, they may be continued.

Fourth. Order the closure of the spaces and facilities of the University of Girona, except those that are affected by the services that are detailed in the next section.

Fifth. The following are considered critical and essential services, and will remain open, coordinated by the Management:

– Critical laboratory services – Campus security service

– Building and infrastructure control service – Central Registry Office (Rector, 10am to 1pm) Management will keep this list of services up to date.

Sixth. The deadlines for all procedures are suspended and interrupted, as prescribed in the third additional provision of RD 463/2020 of 14 March.

Seventh. Due to force majeure, corrective measures for reinforcement, reduction or suspension of the work or activities contracted by the University will be agreed so that the provision of the services is adapted to the circumstances of each moment.

Eighth. Sessions of collegiate bodies that cannot be postponed shall be convened to deal with only strictly necessary issues, and such sessions shall be held in a not-in- person manner following the Rules of operation of the Electoral Commission

Ninth. The measures in this resolution are developed in the "Response Plan to the incidence of covid-19 at the University of Girona", which is attached, and will be implemented in accordance with the forecasts of the university.

Tenth. This decision shall take effect from the date of signature, and for a period of 15 calendar days.

Eleventh. Publish in full this resolution on the bulletin board of the electronic

headquarters of the University of Girona and in the Official Gazette of the University of Girona.

Against this decision, which ends the administrative route, and regardless of its immediate implementation, the persons concerned may appeal before the rector of the University of Girona within one month from the day following its notification, in accordance with Articles 123 and 124 of Law 39/2015, 1 October, of the common administrative procedure, or bring direct administrative action before the

administrative courts of Girona, within two months from the day following that of its notification, in accordance with Articles 8.3, 14.1 and 46.1 of Law 29/1998 of 13 July, regulator of the contentious-administrative jurisdiction.

In addition, persons may bring any other action they deem appropriate for the defence of their interests.
