7. Diseños experimentales

Yahoo’s team carefully reviews all requests for user data (e.g., subpoenas, court orders, and search warrants). Yahoo has previously objected, and will continue to object, to process that is overbroad or inconsistent with applicable law. Yahoo will also:

- Notify users about third-party requests for their information prior to disclosure, and thereby provide them with an opportunity to challenge requests for their data, unless prohibited by law from doing so (non-disclosure order). Additionally, in exceptional circumstances, such as imminent threats of physical harm to a person, Yahoo may elect to provide delayed notice.

- Yahoo will only disclose content (e.g. email messages, Flickr photos) with a search warrant or the user’s consent.

- Yahoo will provide only that information, which is clearly obligated to provide by the legal process and as allowed by law. Yahoo will resist any overly-broad request for Flickr’s users’ information.

All legal process submitted to Flickr must be valid and comply with applicable substantive and

procedural requirements for the issuance of that type of process. In addition to requiring that all requests for user data comply with ECPA and other applicable laws, Flickr also requires that:

- The legal process specifically identifies the user account that is subject to the request by user ID, email address, screen name or other appropriate identifier. This will help

Yahoo identify the particular Yahoo account subject to the request. Requests to identify users based on real names or IP addresses may be declined.

- All process must be submitted inwriting, unless applicable law specifically allows for an oral request. In such cases, Yahoo may ask for a written request after the fact. - All process must be on official letterhead and contain sufficient information to verify

that the request has originated with an entity or individual authorized to make such request.

Yahoo will generally accept legal process from a U.S. government agency via email to

2. Preservation Request

Consistent with the emergency disclosure provisions in ECPA (18 U.S.C. § 2702), Yahoo will make disclosures to government officials in instances where Yahoo has been provided sufficient information to conclude that disclosure without delay is necessary to prevent

imminent danger of death or serious physical injury to any person. All emergency disclosure requests should be submitted in writing using Yahoo’s Emergency Requests form at

4. Copyright

Yahoo may, in appropriate circumstances and at its discretion, disable and/or terminate the accounts of users who may be repeat infringers.

infringement, or your intellectual property rights have been otherwise violated, please provide Yahoo's Copyright Agent the following information:

- an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
