Without derogating from the generality of the aforementioned and the Contract volumes, the Contractor shall follow the following instructions:

 QC will be conducted by the contractor, at his responsibility and at his expense, for the entire period of work execution, for his work and for the work of his sub-contractors. It is hereby clarified that the contractor will bear complete responsibility for QC on an ongoing basis, and the NI will not be required to take any additional action or payment for this purpose. The Contractor's QC system will be independent and will operate only with the quality assurance system of NI.

 The PM will be entitled, but not required, to review the results of the QC performed by the Contractor, without this obligating the NI to make any additional payment and without this in any way exempting the Contractor from his duty to execute the works at the quality and level required according to the Contract volume and according to law.  The PM will be entitled, at his exclusive discretion, to order, at any time, the execution

of any examination, sampling, measurement, test, etc., in order to test the quality of work execution or any part of it at the NI expense with the exception of the costs of additional tests that were required due to non-compliance of work execution or any part of it with the quality requirements, and the need for their repair and/or replacement. Such retesting will be performed at the Contractor expense. The NI's authority to perform quality assurance does not detract from the Contractor's obligation to execute the works at the quality and level required according to the Contract volume and according to law.

 If the PM discovers that the Contractor is violating his undertaking to conduct quality assurance on an ongoing basis, the PM will be entitled to order the stoppage of work until the violation is corrected to his satisfaction. In the case of such a work stoppage, the time schedule for work execution will not be extended and the Contractor will not be entitled to an increase in payment. This does not detract from any remedy that will be available to the NI as a result.

 The content of this section do not diminish the Contractor's obligation to fulfill any duty imposed on him according to law or according to the Contract volume, including with respect to safety and sanitation issues.

17 Health and safety (H&S) at the Site 17.1 General

Without derogating from the provision of section 11 to the Contract, the Contractor must fulfill all of the demands and instructions given by the Relevant Authorities such as: signs regarding the Contractor's role and responsibility, signs, clearly visible to the public with details of the senior foreman and of the safety officer including his reports and registration with the ministry of labor, periodical certificates attaining to mechanical equipment, lifting equipment, mechanical and electrical tools, personal safety equipment, protection from locations and dangerous materials.

The Contractor is required to fulfill all safety instructions and requirements of all Relevant Authorities, the ministry of labor, BEZEQ international corporation Ltd (telephony corporation), The Israel electric corporation Ltd etc.

The Contractor is required to take all appropriate measures and to faithfully ensure that all required safety and precautionary measures on the Site and access roads are implemented. The Contractor must ensure that all safety regulations regarding the work are faithfully kept by all contractors and employees, including subcontractors, NCs and utilities owners such as BEZEQ international corporation Ltd (telephony corporation), The Israel electric corporation Ltd etc. The Contractor must ensure that all visitors to the Site will be provided all the necessary personal safety equipment and for the awarding of necessary permits for this purpose from all the agencies and Relevant Authorities and all at his sole expense and will not involve separate payment.

The Contractor agrees that he will effectively monitor at all work locations the implementation of all safety regulations that have been legally decided.

Immediately, at the end of each day's work on all parts of the Site the Contractor is required to fill all holes and excavations and complete any fencing that has been damaged.

The Contractor is required to ensure that all his work, including works in the Gilon-tunnels, is carried out in accordance with safety regulations, rescue authorities and the changing conditions of the Site during all stages of work and he must take into account dividing

arrangements, safety and precautionary measures as required by Law, as necessary and as instructed by the PM.

The Contractor must supply, at his expense, luminous vests, regulation work shoes, regulation safety helmets that will be used by all visitors to the Site, safety helmet will be kept in a locked cupboard in the senior foreman offices.

All stated in this section shall be deemed as included in unit prices of the various sections in the BOQ, and the Contractor should not be entitled for any additional payment in this respect. As a minimum the Contractors is expected to provide sufficient personnel to; cover each of the three railway line projects (on a 24/7 basis where required), to interface and liaise with client and consultant teams, to attend regular meetings, to carry out planned and random inspections/surveys/audits etc. and to maintain documentation, provide reports and carry out investigations as per their intended Health & Safety programs.
