(1) The Tribe may charge a license fee, to be set by the Choctaw Nation Gaming Commission, to cover its expenses for investigating and licensing vendors.

(c) Vendor requirement.

(1) All vendors that operate in the gaming operation must be licensed by the Choctaw Nation Gaming Commission. The Choctaw Nation Gaming Commission has established the following definitions:

(i) Gaming Vendor—Any vendor that provides class II or class III electronic gaming machines or devices to a Choctaw Casino.

(ii) Gaming Related Vendor—Any Vendor that provides $25,000 or more annually, of products, services or support to any function of the casino floor, restricted areas, or back of house areas. These vendors include but are not limited to:

(A) Casino consultants;

(B) Vendors that provide vault/soft count equipment; (C) Vendors that supply surveillance equipment;

(D) Suppliers of bingo payer, pull-tabs, cards, chips, table felts, card shufflers; (E) Signage companies;

(F) Check cashing vendor; and

(G) Any other vendor that leases retail space within the casino and has on-site associates.

(d) Vendor permit (Dark Blue/Horizontal).

(1) Any vendor associate/representative working for a non-gaming related vendor that comes to the casino more than five times in any given month to conduct business. These people will be required to complete a personal history information form and pay a $50 permit fee.

(i) Vendors that fall under this category include but are not limited to the following: (A) Food and beverage vendors; and

(B) Company promotion representatives.

(2) Vendor permit must be worn at all times while on casino property, no exceptions.

(3) Placement of the vendor permit must be visible with the front of the card facing out. Do not apply anything extra to the permit such as stickers, name tags or photos.

(4) All vendors are required to scan their badge/permit (if applicable), and check in with Security upon arrival. When leaving they must also check out with Security and scan their badge (if applicable).

(e) Vendor licenses (Pink/Horizontal).

(1) Approval- the Choctaw Nation Gaming Commission will conduct an investigation on the business and its associates that do business with our gaming operation(s). The business may be issued a vendor gaming license only after the approval of the Choctaw Nation Gaming Commissioner.

(2) Denial- the business and/or individual may file an appeal to the Choctaw Nation Gaming Commissioner. If the vendor or vendor associate is found unsuitable for licensing, the gaming license will be revoked.

(3) All vendor gaming licenses shall be reviewed at least every two (2) years for continuing compliance. If the vendor or vendor associate is found unsuitable for renewal, the gaming license will be revoked.

(4) Vendor gaming licenses must be worn at all times while on casino property, no exceptions.

(5) Placement of the vendor gaming license must be visible with the front of the card facing out. Do not apply anything extra to the gaming license such as stickers, name tags or photos.

Page 120 of 121 (6) All vendor associates are required to scan their badge (if applicable), and check in with Security upon arrival. When leaving they must also check out with Security

and scan their badge (if applicable).

(i) If a computerized system (EZ Lobby) is not in use at the facility that tracks Vendor/Visitor visits, the Vendor/Visitor/Temporary Log must be utilized and include the following information:

(A) Date;

(B) Company Name or Site Name; (C) Company or Site Representative;

(D) Vendor License Number or Temporary License Number; (E) Reason for Visit;

(F) Time In;

(G) Security Officer Signature & Gaming License Number (an associate can log in vendors/visitors at Travel Plazas); (H) Time Out; and

(I) Security Officer Signature & Gaming License Number (an associate can log in vendors/visitors at Travel Plazas). (7) Vendor associates are not allowed access to secure/restricted areas without a proper (authorized) escort.

(8) Vendor associates are not allowed access to casino computer/technology equipment without prior approval from the Casino Information Technology Department. (9) When a vendor associate resigns or is terminated, the vendor gaming license should be returned to the Choctaw Nation Gaming Commission. If the license is

unavailable to be returned, the vendor shall notify the Choctaw Nation Gaming Commission immediately.

(f) Gaming machine vendor(s) professionalism.

(1) Vendor associates must maintain a professional business image by wearing proper attire or uniform. (2) Choctaw Casinos adhere to a drug-free and alcohol-free workplace and require the same from the vendors. (3) Firearms are not permitted on the casino premises by any vendor.

(4) The Choctaw Nation Gaming Commission has the right to revoke or deny a vendor gaming license at any time, with due cause.

(5) Vendor associates are prohibited from playing the gaming machines at any Choctaw Nation of Oklahoma Casino except in the course of gaming machine testing approved by Casino Management or the Choctaw Nation Gaming Commission.

(g) Gaming machine requirements.

(1) Gaming device vendors must have paid all licensing fees, as established by the Choctaw Nation Gaming Commission, prior to machine delivery.

(2) Gaming machine software must be in compliance and must meet all regulations of the Compact entered between the Choctaw Nation of Oklahoma and the State of Oklahoma.

(3) Each gaming device and related software manufacturer must provide a certified opinion by an Independent Testing Laboratory (“ITL”).

(4) All information pertaining to the gaming machine must be provided to the Choctaw gaming operation and the Choctaw Nation Gaming Commission prior to “live” play.

(h) Choctaw Nation Gaming Commission requirement for shipping gaming machine software.

(1) Notification of shipment/delivery must be received within seven (7) full business days prior to the requested date of shipment.

(i) Software testing.

(1) The Technical Compliance Department of the Choctaw Nation Gaming Commission will test all gaming software prior to machine installation in any Choctaw Casino.

(2) All media/software must be shipped separately from the gaming machine to the Choctaw Nation Gaming Commission. (3) Testing will ensure game software matches that certified by the ITL.

(4) Software must not be shipped to the Choctaw Nation Gaming Commission that is revoked or has a non-mandatory upgrade status.

(5) The Technical Compliance Department of the Choctaw Nation Gaming Commission will ensure the integrity of the software before the games are turned on for “live” play.

(j) Gaming machine hardware requirements.

(1) Every gaming machine in Choctaw Casinos must have a functional Uninterrupted Power Supply (UPS) backup to alleviate downtime from power outages. (2) The game server shall be housed in a game server room or a secure locked cabinet.

(3) Any excess hardware that is contained inside the gaming machine shall be kept in a manner to avoid clutter.

(4) Any access into the game server room shall be approved by the Choctaw Nation Gaming Commission or Casino Information Technology Department prior to entry. Upon entry, all associates shall complete the sign-in log unless electronic badge access is used to enter the room by those associates. Electronic Badge Access Reports can be used as record of access to the server room. Any associate entering the server room that does not possess electronic badge access shall have a Security escort and be required to complete the sign in log located inside the server room.

(5) Vendor storage rooms must be secure at all times. These rooms contain various gaming machine inventory; therefore, access shall be limited to Vendor Associates, limited Gaming Associates and Choctaw Nation Gaming Commission Associates.

(6) Random Access Memory (RAM) clears shall not be performed without completing the proper paperwork and receiving prior approval from the Choctaw Nation Gaming Commission and must be submitted to the Cage Accounting Manager.

(7) Software updates, pay table changes, server updates, or any other changes must have prior approval from the Choctaw Nation Gaming Commission. (8) Only Choctaw Nation Gaming Commission Associates are permitted to place a Gaming Commission Seal. Before breaking a seal, proper approval must be

received from the Choctaw Nation Gaming Commission. Tampering with a Choctaw Nation Gaming Commission Seal is prohibited.

(i) If any non-casino or casino associate tampers with a Choctaw Nation Gaming Commission Seal without Choctaw Nation Gaming Commission approval or knowledge, disciplinary action shall be taken that may result in a Notice of Violation (NOV) and/or gaming license suspension.

(9) Vendors must always have a Security Officer present to access a machines bill acceptor canister, unless the machine is new to the facility and has not previously operated in Choctaw Casinos.

(k) Remote access. Gaming related remote access is prohibited, unless the Casino Information Technology Department has approved the access and the individual utilizing remote access is licensed through the Choctaw Nation Gaming Commission.

(l) Wide-area jackpot procedures. Vendors are required to provide the Choctaw Casinos and the Choctaw Nation Gaming Commission with rules and procedures to be followed for verifying the legitimacy of the jackpot and to ensure that it is a valid payout.

(m) Termination of vendor associates. The Choctaw Nation Gaming Commission must be notified immediately of any terminated vendor associate. The vendor company must also provide an active list of the associates for each casino, as requested by casino management or Choctaw Nation Gaming Commission.

(n) Policy & Procedure Changes. Any changes made to a department’s policies and procedures must be approved by the Choctaw Nation Gaming Commission prior to the implementation of such policy.
