The legal authority and operating control of the institution are clearly defined for the following areas within the institution's governance structure:

3.2.2.1 Institution's Mission

The legal authority and operating control of Southwest Georgia Technical College (SWGTC) and all of Georgia’s technical colleges are clearly defined in the Official Code of Georgia Annotated (OCGA) § 20-4-11 (Powers of the board) and State Board policy I.C.1. State Board Responsibilities and Authority. OCGA 20-4-11 (legislation) empowers the State Board of Technical and Adult Education (State Board) to provide literacy, occupational, and technical education for Georgia citizens. This (code) legislation defines and supports the mission of SWGTC.

3.2.2.2 Fiscal Stability of the Institution

The legal authority and operating control of SWGTC are clearly defined for the fiscal stability of the institution within the institution's governance structure in OCGA 20-4-11 (item #11). This legislation states the following:

Submit an annual request for funding to the Office of Planning and Budget as prescribed in Code Sections 45-12-78 and 45-12-79. Such submission shall reflect a request for funds

pursuant to an enrollment driven formula that reflects funds for direct instructional costs to include salaries and instructional supplies and equipment, funds for indirect support,

maintenance and operation, staff and professional development, and media services. Such funding shall be subject to appropriation by the General Assembly.

Furthermore, State Board policy I.C.1. State Board Responsibilities and Authority (item #8) states, “Review recommendations for annual and supplemental budget requests for all public postsecondary technical and adult education and make recommendations to the Governor and the General Assembly.”

3.2.2.3 Institutional Policy, Including Policies Concerning Related and Affiliated Corporate Entities and all Auxiliary Services

The legal authority and operating control of SWGTC are clearly defined within the institution's governance structure for institutional policy, including policies concerning related and affiliated corporate entities and all auxiliary services in OCGA 20-4-11 (item #2). This legislation specifically states:

Establish and promulgate standards, rules, regulations, and policies for the orderly and efficient operation of the Department of Technical and Adult Education (the Department of Technical and Adult Education officially changed its name to the Technical College System of Georgia effective July 1, 2008) and of postsecondary technical schools, programs, and institutions, including those which it operates and those operated by local and area boards of education, and for the orderly and efficient provision of adult literacy education programs.

Additionally, State Board policy I.C.1. State Board Responsibilities and

Authority establishes that “The Board shall: 1) Provide overall policy guidance to the Commissioner, who is responsible for day-to-day operations on behalf of the Board." It further establishes that "The Board shall: 2) Approve overall goals and objectives for public postsecondary technical and adult education."

Auxiliary funds (or enterprise funds) are specifically addressed in State Board policy II.A.2.d. Enterprise Funds. All enterprise funds are under the direct management, control, and supervision of the President who has designated day-to-day operational management of these funds to the Vice President of Administrative Services (VPAS) as evidenced in his Job Description.

Southwest Georgia Technical College (SWGTC) owns and operates a College bookstore on the Main Campus of the College. The College also outsources all vending services for students its Main Campus and two of its off-campus sites: SWGTC of Grady County and

SWGTC of Mitchell County. SWGTC does not provide any other auxiliary services. The only other related or affiliated corporate entity is the SWGTC Foundation, which is described in Comprehensive Standard 3.2.2.4.

3.2.2.4 Related Foundations (Athletic, Research, etc.) and Other Corporate Entities Whose Primary Purpose Is to Support the Institution and/or Its Programs.

The legal authority and operating control of SWGTC are clearly defined for institutional policy, including policies concerning related and affiliated corporate entities and all auxiliary services in OCGA 20-4-11. An excerpt of this code follows:

The State Board of Technical and Adult Education shall be empowered to:

(2) Establish and promulgate standards, rules, regulations, and policies for the orderly and efficient operation of the Department of Technical and Adult Education and of postsecondary technical schools, programs, and institutions, including those which it operates and those operated by local and area boards of education, and for the orderly and efficient provision of adult literacy education programs:

(A) Such standards, rules, regulations, and policies may include but not be limited to developing criteria for the recruitment, employment and retention of faculty and staff; recruitment of students and student admissions; program approval, salaries and salary supplements, tuition, and fees; eligibility of public and private providers of adult literacy education programs for state and federal funds, levels of funding for such providers and associated levels of required provider matching funds; long and short-term planning to include facilities, program standards, and outcome competencies; establishing provisions for appropriate recognition of program achievement below the baccalaureate level; soliciting resources from the private sector; industry and education partnerships; research and data collection; representing postsecondary technical and adult literacy education in all forums; and such other functions necessary to assure an effective and efficient statewide system of postsecondary technical schools and adult literacy education with leadership at the state level . . .

The SWGTC Foundation is a separate, independent, and private incorporated legal entity and is described in more detail in Comprehensive Standard 3.2.13.
