We, Mohammed bin Rashid Al Maktoum, Ruler of Dubai,
After perusal of Federal Law No. (20) of 1991 Issuing the Civil Aviation Law and its amend- ments,
Federal Law No. (4) of 1996 Concerning the General Civil Aviation Authority and its amendments,
Law No. (8) of 2006 Establishing Dubai Avi- ation City Corporation and its amendments, and
Law No. (21) of 2007 Establishing Dubai Civil Aviation Authority,
do hereby issue the following Law:
Article (1)
The following words and expressions wher- ever mentioned in this Law shall have the meaning indicated opposite each of them un- less the context implies otherwise:
State: The United Arab Emirates.
Emirate: The Emirate of Dubai.
Ruler: His Highness the Ruler of Dubai.
Government: The Government of Dubai. Authority: Dubai Civil Aviation Authority.
General Authority: General Civil Aviation Authority.
Director General: Director General of the Authority.
Article (2)
The provisions of this Law shall apply to Dubai
Civil Aviation Authority established by virtue
of the above mentioned Law No. (21) of 2007 which has legal personality and the neces- sary legal capacity to achieve its objectives.
Article (3)
The Authority shall have the following func- tions and powers:
1. To define the general policy of civil aviation in the Emirate in line with federal legislation; 2. To carry out the activities related to the management of civil aviation operations in line with federal legislation;
3. To submit requests for modification of the airspace of the Emirate to the General Au- thority for approval in accordance with by- laws issued by the General Authority in this regard;
4. To designate prohibited, restricted or dan- gerous air navigation zones in the Emirate and to inform the General Authority of such zones;
5. To follow up the implementation of bilater- al and multilateral agreements regulating air transport services in the Emirate;
6. To authorise foreign air operators licensed by the General Authority to operate scheduled or non-scheduled flights to the Emirate’s air- ports;
7. To regularly provide the General Authority with statistical information and data relating to civil aviation operations and activities in the Emirate;
8. To represent the Emirate in the State’s del- egation in negotiations relating to air naviga- tion and transport;
9. To sign bilateral memorandum of un- derstanding relating to air transport rights through the Emirate’s airports in coordination with the General Authority;
10. To apply environmental protection policies in line with federal and local environmental policies;
11. To propose and supervise the implemen- tation of consumer protection legislation in the civil aviation sector;
12. Any other functions related to the regula- tion of civil aviation affairs in the Emirate.
CONCERNING THE DUBAI CIVIL AVIATION AUTHORITY
1Article (4)
The Authority shall have a Director General appointed by a decree of the Ruler. The Director General shall undertake the follow- ing duties:
1. To manage the Authority, and to define and su- pervise the implementation of its general policy; 2. To issue the administrative, financial and technical by-laws and decisions necessary for regulating the work of the Authority; 3. To prepare the Authority’s annual report and submit the same to the Chairman of the Executive Council;
4. To prepare the Authority’s draft annual budget;
5. To appoint auditors and determine their re- muneration;
6. To represent the Authority before third par- ties and enter into contracts on behalf of the Authority;
7. To supervise the executive body of the Au- thority;
8. Any other duties necessary for the man- agement of the Authority.
Article (5)
1. The employees of the Authority nominated by a decision of the Director General shall be authorised as judicial officers in identifying violations of the legislation which is imple- mented under the Authority’s supervision to regulate civil aviation and air navigation. 2. The Authority shall issue permits to the Gen-
any time to airports and civil aviation facilities in the Emirate. These inspectors will identify vi- olations of the legislation which is implement- ed under the General Authority’s supervision.
Article (6)
The financial resources of the Authority shall comprise:
1. The financial appropriations of the Author- ity in the general budget of the Government; 2. Fees and charges for services rendered by the Authority.
Article (7)
In regulating its accounts and records, the Au- thority shall adopt the principles and standards of commercial accountancy. The financial year of the Authority shall commence on 1 January and shall end on 31 December of each year.
Article (8)
The above mentioned Law No. (21) of 2007 and any provision in any other legislation shall be repealed to the extent that they con- tradict this Law.
Article (9)
This Law shall come into force on the day on which it is issued and shall be published in the Official Gazette.
